MINUTE ORDER signed by District Judge Kirk E. Sherriff on 12/15/2025: Respondents' 14 motion to modify the Court's 13 preliminary injunction order is denied. The Court's 13 order granting petitioner's motion for preliminary injunction did not enjoin petitioner's removal to Laos. The Court's order provided that respondents may re-detain petitioner for purposes of such removal upon a neutral decisionmaker "determin[ing] that there is a significant likelihood of petitioner's removal in the reasonably foreseeable future...." Doc. 13 at 16. Respondents request that the Court modify the preliminary injunction to allow them to require petitioner to self-surrender to their custody for purposes of removal to Laos pursuant to a new travel document and to allow respondents to take petitioner into custody if he fails to self-surrender. Doc. 14 at 4-5. But while respondents assert that they have now obtained a new travel document for petitioner that will allow them to remove him from the United States to Laos, they have not submitted the travel document or any declaration authenticating any such travel document. Nor do respondents indicate that they have provided the travel document to petitioner or to a neutral decisionmaker in petitioner's immigration proceedings. Given the alleged deficiencies that petitioner identified in the prior travel document that respondents obtained, and the fact that respondents did not address petitioner's allegations as to the prior travel document, the Court denies respondents' motion, which is based on their unauthenticated claim that they now have a new travel document. Consistent with the Court's 13 order, respondents may re-detain petitioner to remove him from the United States to Laos if a neutral decisionmaker first determines that respondents have a valid travel document for petitioner and that there is a significant likelihood of his removal in the reasonably foreseeable future.
