District Judge F. Dennis Saylor, IV: ELECTRONIC ORDER entered. In an earlier case (26-cv-11112), the Court granted petitioner’s petition for a writ of habeas corpus. Following this decision, on March 19, 2026, petitioner was granted a bond hearing before an immigration judge, at which the judge denied bond on the ground that the government had proved by clear and convincing evidence that petitioner was a danger to the community. See Hernandez-Lara v. Lyons, 10 F.4th 19, 40 (1st Cir. 2021). Petitioner appealed the IJ’s decision, and his appeal remains pending before the Board of Immigration Appeals. Petitioner subsequently filed another petition for a writ of habeas corpus in this court, in which he contends, in part, that the procedures employed at his bond hearing were fundamentally unfair and that his continued detention therefore violates his due-process right. The case was originally assigned to Judge Kelley but was reassigned to this session on May 1, 2026. Before it was reassigned, the government filed a response, but that response did not address the substance of the challenge petitioner raises to his continued detention following a bond hearing.To aid the Court in resolving the issues raised by petitioner’s second petition, the government is ordered to respond to the new arguments raised by petitioner no later than May 11, 2026.(MAC) (Entered: 05/04/2026)
