Judge Allison D. Burroughs: ELECTRONIC ORDER entered. Before the Court is Petitioner Jiang Ming Chen’s petition for writ of habeas corpus. [ECF No. 1 ]. Respondents submit that the legal issues presented by the petition are similar to those addressed in Duran Siguenza v. Moniz, No. 25-cv-11914, 2025 WL 2734704 (D. Mass. Sep. 25, 2025), and that “[s]hould the Court follow its reasoning in Siguenza, it would reach the same result here.” [ECF No. 7 at 1]. Accordingly, they “submit that the Court may resolve this Petition without further briefing or oral argument.” [Id.]In Duran Siguenza, the Court, pursuant to Zadvydas v. Davis, 533 U.S. 678 (2001), ordered the release of a habeas petitioner who was subject to a final order of removal, had been detained for more than six months, and was not significantly likely to be removed in the reasonably foreseeable future. Duran Siguenza, 2025 WL 2734704, at *3–4. As Respondents recognize, the facts of this case are similar in all relevant respects. See [ECF No. 7 at 1]. Petitioner is subject to a final order of removal, [ECF No. 1 ¶ 35], has been detained for more than six months, see [id. ¶ 42], and Respondents have not proffered any plans for his removal in the reasonably foreseeable future, see [id. ¶¶ 44–45]; [ECF No. 7 ].Accordingly, Petitioner’s petition, [ECF No. 1 ], is GRANTED. Respondents are ORDERED to release Petitioner subject to conditions of release to be determined contemporaneously with his release from custody. Respondents are ORDERED to file a status report within 7 days of this order.(CAM) (Entered: 05/07/2026)
