MINUTE ORDER (Text Only Entry) issued by Relief Courtroom Deputy for District Judge Dale A. Drozd on 4/24/2026: On 4/20/2026, a motion for temporary restraining order was filed on behalf of immigration detainee petitioner Pedro Martin Ventura Lopez through next friend Francisco Marquez Bernal. (Doc. No. 3 .) Mr. Marquez Bernal has also filed a motion to appoint counsel on petitioner's behalf. (Doc. No. 2 .) The court incorporates its reasoning set forth in Argueta-Guevara v. Johnson, No. 1:26-cv-02161-DAD-CSK, 2026 WL 785868, at *1 (E.D. Cal. Mar. 20, 2026) and concludes that, because Mr. Marquez Bernal is proceeding in a pro se capacity, the motion for temporary restraining order must be denied. However, pursuant to the reasoning set forth in Alvarado v. Johnson, No. 1:26-cv-02711-DAD-CKD, 2026 WL 983168 (E.D. Cal. Apr. 13, 2026), the court concludes that the appointment of counsel is appropriate under the circumstances. Mr. Marquez Bernal alleges that petitioner Pedro Martin Ventura Lopez entered the United States in 2003, has no criminal history, and was detained inside this country. Accordingly, petitioner may be likely to succeed on the merits of his claim pursuant to the reasoning set forth in Quichimbo-Jimenez v. Warden, Cal. City Corr. Ctr., 2:26-cv-00739-DAD-EFB, 2026 WL 679378 (E.D. Cal. Mar. 10, 2026) and Cardenas v. Chestnut, et al., No. 1:26-cv-02073-DAD-SCR, 2026 WL 785871, at *1 (E.D. Cal. Mar. 20, 2026). The court finds that petitioner's ability to articulate his claims pro se is likely hindered by allegedly being transferred across multiple facilities. Accordingly, the court concludes that the interests of justice would be served by the appointment of counsel. For these reasons: (1) Petitioner's motion for temporary restraining order (Doc. No. 3 ) is DENIED without prejudice to its refiling; (2) Petitioner's motion for appointment of counsel (Doc. No. 2 ) is GRANTED as follows: (A) The matter is hereby REFERRED to the Federal Public Defender's Office of this district to determine if petitioner is financially eligible for appointment of counsel pursuant to 18 U.S.C. § 3006A(a)(2)(B), and if so to identify counsel for petitioner; (B) The Clerk of the Court shall serve a copy of this order and the petition for writ of habeas corpus on the Federal Defender, Attention: Habeas Appointment; and (C) Within thirty (30) days of the date of service of this order, a notice shall be filed with the Court by the Federal Public Defender's Office regarding whether petitioner is financially eligible for appointment of counsel and, if so, identifying counsel to be appointed at petitioner's behalf.
