Minute Order by Judge Jinsook Ohta: Petitioner Amos Nkongolo Mubanga filed a motion to proceed in forma pauperis ("IFP"). Dkt. 2. Civil Local Rule 3.2 requires a litigant seeking IFP status to submit an affidavit of assets demonstrating an inability to pay the filing fee to maintain a civil action. Because Petitioner has submitted an affidavit attesting that he has no assets or income, the Court finds that he has demonstrated an inability to pay the $5 filing fee. Minute Order by Judge Jinsook Ohta: The Court finds that representation is necessary given the complexity and potential validity of the constitutional, statutory, and procedural issues presented. Weygandt v. Look, 718 F.2d 952, 954 (9th Cir. 1983). Accordingly, the Court CONDITIONALLY APPOINTS Federal Defenders of San Diego, Inc. as counsel effectively immediately. As Petitioner's current petition only broadly references the Fifth Amendment, the Court orders Petitioner to file an amended petition and/or supplemental brief addressing (1) whether his prolonged detention without a bond hearing violates his procedural due process rights; AND (2) whether such detention violates his substantive due process rights, and if so, whether he is entitled to immediate release. Petitioner's filing is due by 12 p.m. on May 21, 2026. Respondents shall file a response addressing both the substantive and procedural due process issues by 12 p.m. on May 28, 2026. Petitioner shall file a reply by 12 p.m. on June 2, 2026. The Court VACATES the May 14, 2026 hearing and SETS a hearing with oral argument on June 4, 2026 at 9:30 a.m. in Courtroom 4C, to be heard at the same time as BoukouBongue v. Casey, 26-cv-2491, because both cases present similar issues. The Court ORDERS Petitioner to submit a form CJA 23 financial affidavit by May 21, 2026 to demonstrate financial eligibility.
