MINUTE ORDER issued by Courtroom Deputy for Chief District Judge Troy L. Nunley on April 22, 2026: The Court has reviewed pro se Petitioner's Writ of Habeas Corpus in which he asks the Court to "construct a motion for temporary restraining order." (ECF No. 1 ). The Court does so. See Estelle v. Gamble, 429 U.S. 97, 106 (1976) (pro se litigants entitled to liberal construction). Accordingly, Respondents shall file any opposition to Petitioner's motion for TRO by February 24, 2026 at 2:00 p.m. Any response must include Petitioner's Form I-213 for each immigration encounter, any orders of release or detention, any custody warrants or notices, and any other portions of Petitioner's A-File relevant to the determination of the issues presented in the motion for TRO. Respondents shall also identify whether they have any objection to converting the motion for TRO into a motion for preliminary injunction and whether they request a hearing. Failure to timely respond shall be construed as a non-opposition. See L.R. 230(c). Pending the Court's ruling on this petition, the Court ORDERS that Respondents shall not transfer petitioner out of this District. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 608 (1966) (noting court's "express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction"). The Clerk of the Court shall serve a copy of this order together with a copy of the petition for writ of habeas corpus on the U.S. Attorney's Office. MINUTE ORDER issued by Relief Courtroom Deputy for Chief District Judge Troy L. Nunley on 05/06/2026: Before the Court is Petitioner's motion for temporary restraining order ("TRO") as construed by this Court. (ECF Nos. 1, 3 .) Respondents opposed the motion. (ECF No. 5 .) Petitioner contends his detention violates the Immigration and Nationality Act and the U.S. Constitution. (See. ECF No. 1 .) Respondents counter that Petitioner is detained under 8 U.S.C. § 1226(c)(1)(A) as an alleged controlled substance trafficker under 8 U.S.C. § 1182(a)(2)(C). (ECF No. 5 .) Petitioner was detained about March 20, 2026, thus, he has been detained for less than two months and his detention is not unlawfully prolonged. Therefore, Petitioner has not carried his burden of a likelihood of success on his claims. See Winter v. Nat. Res. Def. Council, Inc., 555 U.S. 7, 20 (2008) (standard for TRO). Accordingly, Petitioner's request for immediate relief is DENIED. Petitioner's newly appointed counsel may file an amended Petition for Writ of Habeas Corpus by May 18, 2026. This matter is referred to the assigned United States Magistrate Judge for all further proceedings. This Court's Order not to transfer Petitioner outside of the district remains intact. (ECF No. 3 .)
