STANDING ORDER IN RE CASES FILED BY PRO SE PLAINTIFFS (See 24-MISC-127 Standing Order filed March 18, 2024). To ensure that all cases heard in the Southern District of New York are handled promptly and efficiently, all parties must keep the court apprised of any new contact information. It is a party's obligation to provide an address for service; service of court orders cannot be accomplished if a party does not update the court when a change of address occurs. Accordingly, all self-represented litigants are hereby ORDERED to inform the court of each change in their address or electronic contact information. Parties may consent to electronic service to receive notifications of court filings by email, rather than relying on regular mail delivery. Parties may also ask the court for permission to file documents electronically. Forms, including instructions for consenting to electronic service and requesting permission to file documents electronically, may be found by clicking on the hyperlinks in this order, or by accessing the forms on the courts website, nysd.uscourts.gov/forms. The procedures that follow apply only to cases filed by pro se plaintiffs. If the court receives notice from the United States Postal Service that an order has been returned to the court, or otherwise receives information that the address of record for a self-represented plaintiff is no longer valid, the court may issue an Order to Show Cause why the case should not be dismissed without prejudice for failure to comply with this order. Such order will be sent to the plaintiffs last known address and will also be viewable on the court's electronic docket. A notice directing the parties' attention to this order shall be docketed (and mailed to any self-represented party that has appeared and has not consented to electronic service) upon the opening of each case or miscellaneous matter that is classified as pro se in the court's records. (Signed by Judge Laura Taylor Swain on 3/18/2024) (nb) (Entered: 11/04/2025)

ORDER TO SHOW CAUSE: Petitioner, who is detained in the Southern District of New York, brings this petition for a writ of habeas corpus under 28 U.S.C. § 2241. The petition was filed on Petitioner's behalf by Hilda Cecilia Villegas, Petitioner's wife. The Court, having examined the Section 2241 petition, hereby ORDERS that: (1) Within three days of the date of this order, i.e., by November 7, 2025, the U.S. Attorney's Office shall file an opposition as to why this petition for a writ of habeas corpus should not be granted. (2) Petitioner shall have the opportunity to reply by November 11, 2025. (3) This matter shall be heard by the Court on November 14, 2025, at 10 a.m. in the Daniel Patrick Moynihan United States Courthouse, Courtroom 20B, 500 Pearl Street, New York, NY 10007. Respondent shall produce Petitioner at this hearing. (4) To preserve the Court's jurisdiction pending a ruling on the petition, Petitioner shall not be transferred, except to a facility within this District or the Eastern District of New York, absent further order of this Court. Respondents shall promptly notify the Court before any change in Petitioner's location. (5) To preserve the Court's jurisdiction pending a ruling on the petition, Petitioner shall not be removed from the United States unless and until the Court orders otherwise. See, e.g., Kuprashvili v. Flanagan, No. 25-CV-5268 (PAE) (S.D.N.Y. June 30, 2025) (collecting cases staying removal to maintain the status quo). (6) The Clerk of Court shall electronically notify the Civil Division of the U.S. Attorney's Office for the Southern District of New York of this order at the following email address: jeffrey.oestericher@usdoj.gov. Replies due by 11/11/2025. Show Cause Hearing set for 11/14/2025 at 10:00 AM in Courtroom 20B, 500 Pearl Street, New York, NY 10007 before Judge Jennifer L. Rochon. ORDER DIRECTING PAYMENT OF FEE OR IFP APPLICATION: Hilda Cecilia Villegas, acting as next friend of Petitioner Lisual Armando Guzman Andujar brings this petition for a writ of habeas corpus under 28 U.S.C. § 2241. To proceed with a petition for a writ of habeas corpus in this court, a petitioner's next friend must either pay the $5.00 filing fee or, to request authorization to proceed in forma pauperis (IFP), submit a signed IFP application. See 28 U.S.C. §§ 1914, 1915. The petition was submitted without the filing fee or an IFP application. Within thirty days of the date of this order, Petitioner's next friend must either pay the $5.00 filing fee or complete and submit the attached IFP application. Payment of the fee should be mailed to the following address: United States District Court for the Southern District of New York, Cashiers-Room 260, 500 Pearl Street, New York, NY 10007. Payment of the fees by mail must (1) be made by money order or certified check; (2) be made payable to: Clerk, USDC, SDNY; and (3) include the docket number listed above. Personal checks are not accepted. Payment of the fees also can be made in person at the courthouse by credit card, money order, certified check, or cash. If the IFP application is submitted, it should be labeled with docket number 25-CV-09199 (JLR). If Petitioner fails to comply with this order within the time allowed, the action will be dismissed without prejudice. Petitioner's next friend may receive court documents by email by completing a Consent to Electronic Service form. The Court certifies under 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore IFP status is denied for the purpose of an appeal. Cf. Coppedge v. United States, 369 U.S. 438, 444-45 (1962) (holding that appellant demonstrates good faith when seeking review of a nonfrivolous issue). Filing Fee due by 12/4/2025. In Forma Pauperis (IFP) Application due by 12/4/2025. (Signed by Judge Jennifer L. Rochon on 11/4/2025) (rro) (Entered: 11/05/2025)

ORDER GRANTING PRO BONO COUNSEL: IT IS HEREBY ORDERED THAT the Clerk of Court is directed to attempt to locate pro bono counsel to represent Petitioner in this case. It should be noted that the Court does not have the authority to "appoint" counsel, but instead, may only "request" that an attorney volunteer to represent a litigant pro bono. Mallard v. U.S. Dist. Court for the S. Dist. of Iowa, 490 U.S. 296, 301-10 (1989). If an attorney volunteers, the attorney will contact Petitioner, or his next friend, directly; IT IS FURTHER ORDERED if Petitioner has already successfully secured counsel on his own, or otherwise does not wish the Court to seek volunteers for pro bono counsel, he must inform the Court by November 7, 2025; and IT IS FURTHER ORDERED that the Clerk of the Court is directed to immediately e-mail a copy of this Order to the Petitioner in care of his next friend, Hilda Cecilia Villegas, at sesyfernandez26@gmail.com. SO ORDERED. (Signed by Judge Jennifer L. Rochon on 11/5/2025) (jca) (Entered: 11/05/2025)
