ENDORSED ORDER denying Emergency Petition for Writ of Habeas Corpus. Petitioner Yvonne Tracey requests "an emergency ruling" on her petition for writ of habeas corpus, alleging that she has been ordered to present a travel ticket for removal to a third country by April 21, 2026. The petition fails to establish entitlement to the issuance of the writ and, for that reason, Ms. Tracey's request for an ex parte order enjoining respondents from removing petitioner is DENIED. First, the petition names four respondents, without alleging which one of the respondents is Ms. Tracey's immediate custodian. Indeed, the petition alleges facts from which one could conclude that Ms. Tracey is neither a "prisoner" nor "in custody," as those terms are used in 28 U.S.C. § 2241. Second, the petition fails to articulate a legal basis for the grant of any ex parte relief. The factual basis alleged for the existence of an "emergency" is unclear, aside from the fact that Ms. Tracey has a deadline of today and she has sought out medical care. Notably, Exhibit F to the petition reflects that the Department of Homeland Security notified Ms. Tracey and her attorney on April 8, 2026 that Ms. Tracey was required to return at 8 a.m. on April 21, 2026 "with arrangements for a country of your choice leaving from Orlando International Airport on or before May 1st, 2026." Third, the petition is an impermissible shotgun pleading that lumps the respondents together in a fashion that does not permit identification of who Ms. Tracey alleges did what and when. In light of the foregoing, the Emergency Petition is due to be dismissed. This dismissal is without prejudice and if Ms. Tracey chooses to re-file she must do so using the same case number and, if the petition is refiled, Ms. Tracey must remedy the defects mentioned here and she must include a memorandum of law more specifically identifying the basis of the Court's authority to issue the writ under 28 U.S.C. § 2241 to an individual who is not a prisoner in the actual custody of a respondent but instead is alleged to be in "constructive custody." Additionally, any amended petition must comply with all Middle District of Florida Local Rules, including the rules governing requests for a temporary restraining order or preliminary injunction.
