ORDER DENYING 7 Motion for Temporary Restraining Order. In the 7 Motion, Petitioner seeks, inter alia, an order enjoining Respondents from transferring Petitioner outside of the Western District of Pennsylvania and from removing him from the United States pending resolution of his habeas petition. The Court will deny the 7 Motion because it lacks jurisdiction to grant that relief. First, the Court lacks the authority to enjoin Petitioner's transfer. The place of an alien's detention is left to the discretion of the Attorney General and courts lack jurisdiction to enjoin a detainee's transfer. See Calla-Collado v. Attorney General of the US, 663 F.3d 680, 685 (3d Cir. 2011). Second, the Court likewise lacks jurisdiction to enjoin Petitioner's deportation. The Third Circuit has held that 8 U.S.C. § 1252(b)(9) strips district courts of jurisdiction over claims that would require a court to decide whether the Government may lawfully remove a noncitizen, even before a final order of removal has been issued, where those claims can later be meaningfully reviewed in a petition for review. Khalil v. President, United States, 164 F.4th 259, 273 (3d Cir. 2026). Here, Petitioner asks this Court to enjoin his removal. Petitioner has not shown that any legal challenge to his removal could not be meaningfully reviewed outside of emergency relief. Thus, the Court lacks jurisdiction to enjoin his removal from the United States.Accordingly, IT IS HEREBY ORDERED that the 7 Motion for a Temporary Restraining Order is DENIED.
