PAPERLESS ORDER striking 7 Motion for Expedited Order to Show Cause and Immediate Release Pursuant to 28 U.S.C. § 2241 or, in the Alternative, for Temporary Restraining Order and Preliminary Injunction ("Motion") as it suffers from several deficiencies. First, Petitioner's Motion is styled as an expedited motion requesting an order to show cause and immediate release under 28 U.S.C. § 2241. The Court notes that it has already issued an Order to Show Cause (DE 5 ), rendering this request moot. Moreover, because Petitioner has already filed a habeas petition seeking the same relief (DE 1 ), the instant Motion appears duplicative and unnecessary. Second, although Petitioner designates the Motion as "expedited," it fails to comply with Southern District of Florida Local Rule 7.1(d)(2). Third, Petitioner fails to comply with Local Rule 7.1(a)(2), which requires that any motion seeking ex parte relief, or a temporary restraining order, be accompanied by a proposed order. Finally, the Motion is internally inconsistent. Petitioner, through counsel, certifies that he has not provided notice of the Motion to the Government as doing so would be futile, yet his counsel simultaneously represents that she conferred with the Government on November 5, 2025, and that they oppose the Motion. The Motion is therefore not properly styled as ex parte. Accordingly, it is ORDERED AND ADJUDGED that Petitioner's Motion is STRICKEN. Should Petitioner intend to refile, he must fully cure the deficiencies outlined above no later than November 7, 2025. To the extent Petitioner seeks both a temporary restraining order and a permanent injunction, he must file those as separate motions. If Petitioner wishes to proceed solely on his habeas petition, he shall file a notice informing the Court by the same date. Signed by Judge Kathleen M. Williams on 11/5/2025.
