MINUTE ORDER issued by the Courtroom Deputy for District Judge Dena M. Coggins on 5/5/2026: In Respondents' 8 Opposition to Petitioner's 3 Motion for a Temporary Restraining Order, Respondents distinguish Petitioner's claim from those cited in the court's 5 Order by alleging that Petitioner was arrested for obstructing a police officer in July 2025. However, Petitioner contends in his Reply that no charges were brought pursuant to that arrest, and that Petitioner appeared before ICE following that arrest and remained on release on his own recognizance following that appointment. Additionally, the court notes that Respondents do not allege that Petitioner's immigration detention was due to that arrest. Accordingly, Petitioner's claim is materially indistinguishable from Patlan-Gomez v. Wofford, No. 1:25-cv-02072-DC-EFB, 2026 WL 632510 (E.D. Cal. Mar. 6, 2026), and for the reasons explained in Patlan-Gomez, Petitioner's 3 Motion for a Temporary Restraining Order is GRANTED as follows: (1) Petitioner Cristian Camilo Coy Lozano (A-220-982-287) shall be RELEASED IMMEDIATELY from Respondents' custody. Respondents shall not impose any additional restriction on him unless it is determined to be necessary at a future pre-deprivation/custody hearing; and (2) If the Government seeks to re-detain Petitioner, it must provide no less than seven (7) days' notice to Petitioner and must hold a pre-deprivation bond hearing before an Immigration Judge at which the Government shall bear the burden of justifying Petitioner's detention by clear and convincing evidence. The Clerk of the Court is DIRECTED to serve this Order on the Golden State Annex Detention Facility. This matter is REFERRED to the assigned Magistrate Judge for further proceedings.
