MINUTE ORDER issued by Magistrate Judge Chi Soo Kim on 5/22/2026: Good cause appearing, IT IS HEREBY ORDERED that:1. In Respondent's return and opposition, the government contends that petitioner is detained pursuant to 8 U.S.C. 1226(c) and attaches petitioner's rap sheet (See ECF No. 9 ). Respondent does not, however, identify the controlled substance underlying petitioner's 2017 conviction for possession of a controlled substance. (ECF No. 9.) Thus, this Court is unable to determine whether petitioner's 2017 conviction "relate[s] to a controlled substance" under the Controlled Substances Act. Within seven days from the date of this order, Respondent is ordered to submit a supplemental brief limited to five pages and documents addressing its 8 U.S.C. 1226(c) argument.2. Petitioner's motion for appointment of counsel (ECF No. 3) is GRANTED;3. The Federal Defender is appointed to represent Petitioner. Within seven days from the date of this order, the appointing authority for the Eastern District of California shall identify counsel and send counsel's contact information to Alex Waldrop, Courtroom Deputy for the undersigned, via email at awaldrop@caed.uscourts.gov, who shall update the docket to reflect counsel's appointment. If counsel is not a member of the Eastern District of California Criminal Justice Act ("CJA") Panel, the Court hereby authorizes them to serve as pro hac vice CJA counsel for petitioner for the duration of the proceedings in this Court pursuant to Local Rule 180(b)(1). If counsel is not admitted to practice before the Eastern District of California court, pursuant to 18 U.S.C. §§ 3005 and 3006A and this District's CJA Plan, General Order 671, § XV.C.1.g as applied here, the Court hereby authorizes said counsel's pro hac vice admission to practice before this court for the duration of the proceedings, nunc pro tunc to the date the appointing authority first contacted counsel about this appointment.3. Seven days after counsel for Petitioner is identified, Petitioner's counsel shall file a reply. Respondent may file a supplemental response three days after being served with Petitioner's reply. 4.
