Minute Order by District Judge Benjamin J. Cheeks: On April 15, 2026, Petitioner Erick Esau Osorio Nova, a national of Guatemala, filed a Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241. ECF No. 1. Respondents do not oppose the petition and defers to the Court on the appropriate relief. ECF No. 10 at 3. Accordingly, the Court GRANTS in part the petition for a writ of habeas corpus. The government shall hold a bond hearing within fourteen days of this order, unless the noncitizen requests a continuance, and cannot deny bond at the hearing based on 8 U.S.C. § 1225. The government is enjoined from transferring Petitioner before a bond hearing takes place. The petition is otherwise DENIED. The Clerk of Court shall close the case.(tv) (Entered: 06/03/2026)
