Judge Richard G. Stearns: ELECTRONIC ORDER entered re 8 Response to Petition for Writ of Habeas Corpus - 2241 filed by Markwayne Mullin, Patricia Hyde, Todd Blanche, Todd Lyons, Antone Moniz. Petitioner Roman Pyvo is a twenty-four-year-old native and citizen of Ukraine who entered the country legally pursuant to the U4U program and was released into the United States at that time. He has since applied for re-parole in June of 2024 and for Temporary Protected Status in March 2025. Both of those cases remain pending. DHS released him into the United States throughout this time-period. Pyvo was picked up by U.S. Immigration and Customs Enforcement (ICE) on April 13, 2026, when he attempted to appear for a court hearing (after he had checked in but before his hearing) concerning a criminal charge for possession of a Class B Substance at the Dedham District Court. He had not been held by the court when initially charged. As a result of his failure to appear, a warrant has issued, and he has a further hearing in that criminal matter in Dedham on Monday, April 27, 2026. He is currently held at the Plymouth County House of Correction.The court agrees with petitioner Roman Pyvo that he is entitled to a bond hearing and the opportunity to defend himself in court at the Monday, April 27, 2026 hearing. The court orders that defendants facilitate Pyvo's appearance at Dedham District Court (transport) and meeting with his counsel prior to the hearing on April 27, 2026. They also must arrange a bond hearing for Pyvo before an Immigration Judge (consistent with the standards outlined in Hernandez-Lara v. Lyons, 10 F.4th 19 (1st Cir. 2021)), as soon as practicable, but in no case later than Wednesday, April 29, 2026. (MZ) (Entered: 04/24/2026)
