Order [non-document] Yesterday, on the date the Court previously established for Respondent's response, Respondent filed a two-page motion to dismiss, arguing that the Court lacks jurisdiction. See Doc. 5 . In particular, Respondent claims that the petition is moot because Petitioner was removed from the United States and thus the relief sought cannot be granted. See Doc. 5, at 2. Respondent, however, did not provide any supporting documentation or citation to show that Petitioner has, in fact, been removed from the United States. The Court is not inclined to recommend dismissal based on Respondent's unsupported assertion. By May 27, 2026, Respondent must provide evidence to support its assertion that Petitioner has been removed from the United States. Respondent's filing must identify the factual and legal basis for Petitioner's removal and the date of Petitioner's removal. Petitioner's deadline to respond, June 3, 2026, remains in effect.
