Stearns: ELECTRONIC ORDER entered re 6 Response to Petition for Writ of Habeas Corpus - 2241, filed by Kristi Noem, Patricia Hyde, Todd Lyons, Pamela Bondi, Michael Krol, Antone Moniz. Petitioner Gabriel Alberto Perez Ramirez was afforded a bond hearing under 8 U.S.C. § 1226(a), and an Immigration Judge (IJ) denied his request after finding that he "posed a flight risk." Resp. in Oppn to Pet. (Dkt #6) at 1; Ex. 1 (Dkt # 6-1). The Immigration Judge ordered Perez Ramirez removed to Honduras or in the alternative to Columbia on the charge contained in the Notice to Appear. Ex. 2 (Dkt #6-2) at 1. Because petitioner's detention is seemingly mandated by 8 U.S.C. § 1231(a)(2) where, as here, the order of removal is less than ninety days old, and because 8 U.S.C. § 1252(g) precludes a district court from entering a stay of removal while an individual seeks alternative forms of immigration relief, petitioner is ordered to show cause by December 14, 2025, why this case should not be dismissed for lack of jurisdiction.(MZ) (Entered: 12/04/2025)
