MINUTES (IN CHAMBERS) by Judge Otis D. Wright, II: On April 2, 2026, Petitioner Tayupo Garcia Jose filed a Petition for Writ of Habeas Corpus and a Motion for a Temporary Restraining Order and Preliminary Injunction (TRO). (Pet., Dkt. No. 1; TRO, Dkt. No. 2.) Respondents oppose based solely on General OrderNo. 26-05 and the expedited merits briefing schedule therein. (Oppn, Dkt. No. 11.) Respondents do not oppose the TRO substantively on the merits. (See generally id.) In light of Respondents lack of substantive opposition, and after finding that the Petition demonstrates likelihood of success, irreparable injury, and a balance of equities that tilts in Petitioner's favor, the Court GRANTS Petitioner's TRO. Respondents shall immediately release Petitioner from custody. However, the Court DENIES Petitioners request for a preliminary injunction in light of the expedited merits briefing ordered in this case pursuant to General Order 26-05. Pursuant to General Order Nos. 05-07 and 26-05, further proceedings on the merits of the Petition are REFERRED to the assigned Magistrate Judge for decision. (lc) (Entered: 04/13/2026)
