ELECTRONIC ORDER: Before the Court is Petitioner's Motion to Expedite, which requests immediate consideration of his pro se Petition for Writ of Habeas Corpus, Doc. 3, and to shorten Respondents' response time. But a motion for expedited consideration is reserved for situations where a delay would cause significant, irreparable harm that cannot be remedied through ordinary judicial process. And the strict time limits of 28 U.S.C. § 2243 are subordinate to the Court's discretionary authority to set deadlines under Rule 4 of the Rules Governing Section 2254 Cases in the United States District Courts. Petitioner has not met his burden to show good cause to expedite a ruling. Therefore, Petitioner's Motion to Expedite is DENIED. ELECTRONIC ORDER OF SEVERANCE. In addition to seeking habeas relief under 28 U.S.C. § 2241, Petitioner challenges the conditions of his confinement. Doc. 3 at 6. Such a claim is not cognizable under § 2241 and must be brought instead under 42 U.S.C. § 1983. See Nubine v. Thaler, 2010 WL 3681033, at *1 2 (5th Cir. 2010) (per curiam) (noting that court should separate civil rights claims raised in a habeas case) (citing Patton v. Jefferson Corr. Ctr., 136 F.3d 458, 463 64 (5th Cir. 1998)). Accordingly, Petitioners civil rights claims are SEVERED from this action. The Clerk of the Court is directed to open a new civil rights action for the severed matter under 42 U.S.C. § 1983 (NOS code 555 and directly assigned, per Special Order 3-250, to the same judges as this case), and list as Defendants the individuals named in the habeas petition. The Clerk of the Court will file a copy of this order, the habeas petition, and motion to proceed in forma pauperis in the new action. The parties are notified that all future docketing related to the severed matter should be entered in the new case.
