(In Chambers) Order by Judge Stanley Blumenfeld, Jr.: Petitioner filed an ex parte application for a temporary restraining order (TRO) seeking a bond hearing. Dkt. No. 4. General Order 26-05 sets an expedited briefing schedule for immigration habeas petitions because of the inherent exigency arising out of detention; a petitioner seeking relief even sooner must therefore show "imminent, irreparable harm that cannot be addressed by the standard scheduling order[.]" Dkt. No. 7 at 5. Petitioners TRO application, which focuses on the generalized harm from detention and does not identify with sufficient detail any specific, individualized exigency, fails to make the required showing. The Court will therefore consider the TRO application after completion of the expedited briefing. The parties shall follow the same briefing schedule for the TRO application: Respondents shall file a response by April 23, 2026; and Petitioner shall file his reply no later than 3 days after the response is filed. Given the limited nature of the relief sought and that Petitioner appears to be a member of the bond-eligible class certified in Bautista v. Santacruz, No. 5:25-CV-01873-SSS, 2025 WL 3713987 (C.D. Cal. Dec. 18, 2025), the government should promptly review the application to determine if it opposes and file any statement of nonopposition by April 17, if possible, and no later than April 20.
