REPORT AND RECOMMENDATION. The undersigned recommends the Court grant Petitioner's habeas petition in part and order his immediate release. The undersigned also recommends that the Court order the Government to certify compliance with the Court's order by filing a status report within ten business days of the Court'ss order, and to promptly provide a copy of this order to Counsel for the Warden of the Diamondback Correction Facility. Finally, the Court should order that Respondents cannot re-detain Petitioner without notice and a pre-deprivation hearing before a neutral decision-maker where the Government bears the burden of proving, by clear and convincing evidence that Petitioner is a flight risk and a danger to the community.
