TEXT ORDER: The Court has reviewed the Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 (ECF No. 1 ) filed by Petitioner, Odvin Cortez Najarro, who is presently detained at Delaney Hall Detention Facility in Newark, New Jersey. Petitioner alleges that he entered the United States without inspection in 2024 and has resided here since. Petitioner further represents that On April 12, 2026, he attended his scheduled immigration check-in appointment and was subsequently arrested by ICE pursuant to § 1225(b). Petitioner contends that his detention is unlawful and violates the Due Process Clause of the Fifth Amendment. Accordingly, it is ORDERED that Respondents shall SHOW CAUSE, on or before April 22, 2026, why the Petition should not be granted. Petitioner may file a reply within three (3) business days after Respondents file their response. Petitioner shall serve a copy of this Order and the Petition upon Respondents within two (2) business days of the entry of this Order and shall promptly file proof of service on the docket.
