Petitioner, Mariano Gallardo Flores (A# 201-066-803), a self-represented immigration detainee, filed a petition for a writ of habeas corpus (ECF No. 1 ) pursuant to 28 U.S.C. § 2241, along with the filing fee. Because petitioner may be entitled to the requested relief if the claimed violations are proved, respondents will be served with the § 2241 petition and directed to show cause why the writ should not be granted by filing an answer/return. The Clerk of the Court shall serve a copy of this order together with a copy of petitioner's application for a writ of habeas corpus pursuant to 28 U.S.C. § 2241 on the United States Attorney. Respondents are directed to file an answer/return within 14 days from the date of this order. If respondents dispute any factual representations in the operative petition, they shall include with the answer/return any and all documents necessary to support their view of the facts. Petitioner's reply/traverse, if any, is due within 7 days of being served a copy of the respondents' answer/return. Respondents shall NOT TRANSFER petitioner outside of this judicial district, pending further order of the court. MINUTE ORDER issued by Relief Courtroom Deputy for District Judge Dena M. Coggins on 9/18/2026: In Petitioner's 17 Motion for Reconsideration, Petitioner argues that he is entitled to habeas relief separate and apart from that provided to him in this court's 14 Order because (1) this motion "challenges Petitioner's present and continuing detention in light of the extraordinary length of detention and circumstances that continue to exist and have become increasingly significant"; and (2) Petitioner has begun experiencing medical issues that are not being adequately treated in immigration detention. In the court's 14 Order granting his habeas petition, however, the court ordered that Petitioner be provided a bond hearing to address the prolonged nature of his continuing detention. In their 19 Opposition, Respondents confirm that Petitioner was provided such a bond hearing and that the immigration judge applied the standard required by this court. On 9/8/2026 Petitioner filed a 23 Supplement and a 24 Motion to Enforce Judgment, which the court construes as a reply in support of his 17 Motion, in which he states that the bond hearing was deficient but does not detail with specificity any procedural defects in the hearing. To the extent Petitioner argues that the evidence considered by the immigration judge was insufficient to meet the government's burden, that argument is properly raised to the Board of Immigration Appeals, not this court. Loba L.M. v. Andrews, No. 1:25-cv-00611-JLT-SAB, 2026 WL 710307, at *8 (E.D. Cal. Mar. 13, 2026) ("Petitioner challenges the sufficiency of the evidence supporting the immigration judge's bond determination rather than the constitutionality of the process by which that determination was reached... Complaints about the conclusion the IJ reached must be presented through the normal immigration appeal process."). As to Petitioner's arguments relating to his medical care, such challenges to the conditions of confinement are not cognizable in habeas actions under 28 U.S.C. § 2241. See Pinson v. Carvajal, 69 F.4th 1072 (9th Cir. 2023); see also Arauco Mendoza v. Chestnut et al., 1:26-cv-00627-KES-SAB, Doc. No. 9 (Feb. 5, 2026) (denying motion for a temporary restraining other where the petitioner sought "immediate release based on her assertion that she has received constitutionally-deficient medical care while in civil immigration detention"). Accordingly, Petitioner's 17 Motion for Reconsideration is DENIED and Petitioner's 24 Motion to Enforce Judgment is DENIED as having been rendered moot by this Order. This case shall remain closed.
