TEXT ORDER - The Court has reviewed Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 by Petitioner, Okan Yilmaz, challenging the lawfulness of his continued detention under 8 U.S.C. § 1231(a)(6). (ECF No. 1.) Petitioner, a citizen of Turkey, alleges that an Immigration Judge issued a final order of removal on October 12, 2022, which became administratively final on November 11, 2022. Petitioner represents that he has been detained in the custody of U.S. Immigration and Customs Enforcement at Delaney Hall Detention Facility in Newark, New Jersey since March 28, 2026, and that his removal is not reasonably foreseeable within the meaning of Zadvydas v. Davis, 533 U.S. 678 (2001). (Id.) Accordingly, it is ORDERED that Respondents shall SHOW CAUSE, on or before April 22, 2026, why the Petition should not be granted. Respondents' Answer shall address the allegations set forth in the Petition and include all relevant records necessary for the adjudication of Petitioner's claims, including but not limited to documentation concerning the status of Petitioner's removal, the existence and scope of any grant of withholding of removal, efforts undertaken to secure travel documents, and the legal and factual basis for Petitioner's continued detention under 8 U.S.C. § 1231(a)(6). Petitioner may file a reply within three (3) business days after Respondents file their response. Petitioner shall serve a copy of this Order and the Petition upon Respondents within two (2) business days of the entry of this Order and shall promptly file proof of service on the docket.
