EO:The court has received and reviewed Petitioner's Petition for Writ of Habeas Corpus (the "Current Habeas Petition"), ECF No. 1, and Motion for Temporary Restraining Order, ECF No. 4 .As Petitioner notes, he previously filed a Petition for Writ of Habeas Corpus (the "Former Habeas Petition")and Motion for Temporary Restraining Order, and this court denied them on April 2, 2026. See Case No. 25-cv-01711-WBS-SCR, at ECF Nos. 26 and 27 .Following that denial, Petitioner timely filed a Notice of Appeal in that case.Id. at ECF No. 29 .The appeal was processed by the Ninth Circuit on April 9, 2026.Id. at ECF No. 30 .On the same day he filed his Notice of Appeal, Petitioner completed and dated the Current Habeas Petition, though it was not filed until today, April 13, 2026, under Case Number 26-cv-02752-MWJS.Alongside the Current Habeas Petition, Petitioner filed an application to proceed In Forma Pauperis, ECF No. 2 ; a Motion to Appoint Counsel, ECF No. 3 ; and a Motion for Temporary Restraining Order, ECF No. 4 .In the Current Habeas Petition, Petitioner appears to argue that the court only denied the Former Habeas Petition for lack of jurisdiction to order a bond hearing. ECF No. 1, at pg. 6.He accepts that prior ruling for present purposes, and now argues the court should instead order his immediate release. Id.But the court's prior ruling did not only deny the Former Habeas Petition's request for a bond hearing.It also denied the Former Habeas Petition's request for immediate release; as the court there said, Petitioner's "removal proceedings are appropriately advancing in due course" and "his detention during those proceedings is constitutionally permissible -- with or without a bond hearing."Case No. 25-cv-01711-WBS-SCR, at ECF No. 26, at pgs. 25-26 (cleaned up).Accordingly, the claims for immediate release raised in the Current Habeas petition appear to be essentially the same as those the court previously ruled on in its April 2, 2026, ruling.And if they are in fact the same -- and if the pending Notice of Appeal means that Petitioner will have an opportunity to make his arguments to the U.S. Court of Appeals for the Ninth Circuit -- then the court is inclined to dismiss the Current Habeas Petition in light of the April 2, 2026, ruling and -- perhaps most importantly -- the pending appeal.Petitioner is therefore ORDERED TO SHOW CAUSE, on or before April 17, 2026, as to whether there are any factual or legal issues in the Current Habeas Petition (or the accompanying Motion for Temporary Restraining Order) that make it meaningfully different it from the Former Habeas Petition.He may respond by filing a simple letter, in whatever format he chooses.And given the court's issuance of this Order to Show Cause and its consideration of Petitioner's Current Habeas Petition, and unless and until the court orders otherwise, the court ORDERS that respondents shall not transfer or otherwise take Petitioner out of the Eastern District of California.See California Energy Comm'n v. Johnson, 767 F.2d 631, 634 (9th Cir. 1985) ("The All Writs Act, 28 U.S.C. § 1651(a), empowers the federal courts to issue writs of mandamus necessary to protect their prospective jurisdiction.").IT IS SO ORDERED.
