(In Chambers) Order by Judge Stanley Blumenfeld, Jr.: Petitioner's habeas corpus petition challenged the lawfulness of his arrest without a warrant or probable cause that he was a flight risk. The government did not dispute these allegations in its answer. No later than 9:00 a.m. on May 11, 2026, the government shall file a supplemental brief addressing: (1) whether Petitioner was arrested pursuant to an administrative warrant or other statutory or regulatory authority and provide a copy of any arrest warrant, see 8 C.F.R. § 236.1(b); 8 U.S.C. § 1357(a)(2); 8 C.F.R. § 287.8(c)(2); (2) whether Respondents complied with the procedures for warrantless arrests, see 8 C.F.R. § 287.3; and (3) the appropriate remedy for an arrest in violation of INA provisions and regulations applicable to arrests.
