MINUTE ORDER signed by District Judge Kirk E. Sherriff on 4/14/2026: (Text Only Entry). The Court has reviewed the 1 petition for writ of habeas corpus and 3 motion for temporary restraining order. The Court has previously addressed the legal issues raised by petitioner. See e.g., Sergio S.M. v. Noem,No. 1:25-CV-01973-KES-HBK (HC), 2025 WL 3768206 (E.D. Cal. Dec. 31, 2025); R.D.T.M. v. Wofford, No. 1:25-CV-01141-KES-SKO (HC), 2025 WL 2686866 (E.D. Cal. Sept. 18, 2025). The Court intends to rule directly on the 1 petition for writ of habeas corpus, with the understanding that the Court will also consider any arguments made and exhibits submitted in support of the 3 motion for temporary restraining order. See Fed. R. Civ. P. 65(a)(2) ("Before or after beginning the hearing on a motion for a preliminary injunction, the court may advance the trial on the merits and consolidate it with the hearing."); see also 28 U.S.C. § 2243 ("The court shall summarily hear and determine the facts, and dispose of [a petitioner's habeas petition] as law and justice require."); Dzhabrailov v. Decker, No. 20-CV-3118 (PMH), 2020 WL 2731966, at *4 (S.D.N.Y. May 26, 2020) (considering preliminary injunction and merits of habeas petition simultaneously). On or before April 16, 2026, respondents are ORDERED TO SHOW CAUSE as to whether there are any factual or legal issues in this case that distinguish it from the Court's prior orders in Sergio S.M. v. Noem, and R.D.T.M. v. Wofford and justify denying the petition, or indicate the matter is not substantively distinguishable. Pending the Court's decision, and unless and until the Court orders otherwise, the Court ORDERS that respondents shall not transfer petitioner out of this District. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 604 (1966) (noting court's "express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction"). The Clerk of Court is directed to serve a copy of this Order, the petition, and the motion for temporary restraining order on the U.S. Attorney's Office for the Eastern District of California, with a copy to usacae.ecf2241-imm@usdoj.gov. MINUTE ORDER signed by District Judge Kirk E. Sherriff on 5/05/2026: (Text Only Entry): The 3 motion for temporary restraining order is DENIED. Petitioner's motion fails to address the statute governing his detention. Petitioner became subject to removal under 8 U.S.C. § 1226(c)(1)(A) when he was convicted of felony sex abuse of a minor. Respondents' records show that on October 29, 2021, petitioner was convicted of sexual abuse of a minor in violation of Maryland Statute 3-602(b)(1). See Doc. 9, Exh. 3. "Sexual abuse of a minor is a crime involving moral turpitude." Patino-Cardenas v. Barr, 770 Fed. App'x 371, 372 (9th Cir. 2019). The detention of those who have committed such a crime involving moral turpitude is mandated under 8 U.S.C. § 1226(c)(1)(A) and 8 U.S.C. § 1182(a)(2)(A)(i)(I). Petitioner's detention is not prolonged as he has been in ICE custody only since March 2026. The matter is referred to the assigned magistrate judge for further proceedings on the petition. Sherriff on 6/29/2026: Petitioner's 16 motion for reconsideration, 17 motion for immediate release, and 19 second motion for temporary restraining order are denied for the reasons stated in the Court's 13 minute order denying petitioner's first motion for temporary restraining order. Specifically, petitioner's motions fail to address the statute governing his detention, 8 U.S.C. § 1226(c)(1)(A). And given that petitioner is subject to 8 U.S.C. § 1226(c)(1)(A), he is not a member of the Garro Pinchi class. See Garro Pinchi v. Noem, 813 F. Supp. 3d 973, 1010 (N.D. Cal. 2025) (certifying a class consisting of "[a]ll noncitizens in the jurisdiction of the San Francisco ICE Field Office who (1) entered or will enter the United States without inspection; (2) have been or will be charged with inadmissibility under 8 U.S.C. § 1182 and have been or will be released from DHS custody; and who (3) are in removal proceedings under 8 U.S.C. § 1229a, including any § 1229a proceedings that have been dismissed where the dismissal is not administratively final; and (4) are not subject to detention under 8 U.S.C. § 1226(c)" (emphasis added)).
