PAPERLESS ORDER. THIS MATTER is before the Court sua sponte. On April 12, 2026, Petitioner filed an Emergency Petition for Writ of Habeas Corpus and Motion for Temporary Restraining Order and Preliminary Injunction. The Petition, however, suffers from several deficiencies. First, although Petitioner designates the Petition as an "emergency," he fails to comply with Southern District of Florida Local Rule 7.1(d)(1). Second, Petitioner improperly embeds a motion for injunctive relief in his Petition. To the extent Petitioner seeks a temporary restraining order or a preliminary injunction, the Petition fails to cite, mention, or analyze the relevant TRO factors or Rule 65(b) of the Federal Rules of Civil Procedure. Petitioner also fails to comply with Local Rule 7.1(a)(2), which requires that any motion seeking emergency relief or a temporary restraining order must be accompanied by a proposed order. Third, although Count II asserts a due process claim, it sets forth no supporting allegations. Should Petitioner intend to refile, he must cure the deficiencies outlined above no later April 15, 2026. To the extent Petitioner seeks both a temporary restraining order and a permanent injunction, he must file those as separate motions. If Petitioner wishes to proceed solely on his habeas petition, he shall file a notice informing the Court by the same date. Moving forward, the Court expects strict compliance with the Federal Rules of Civil Procedure, the Local Rules for the Southern District of Florida, the Court's Practices and Procedures, and all Court orders. Finally, during the pendency of this action, Respondents SHALL NOT transfer or otherwise move Petitioner from the Miami FDC until further order of the Court. Signed by Judge Kathleen M. PAPERLESS ORDER. THIS MATTER is before the Court sua sponte. On April 15, 2026, Petitioner filed an Amended Petition for Writ of Habeas Corpus challenging his detention at the Miami Federal Detention Center ("Amended Petition") (DE 5 ). PAPERLESS ORDER. THIS MATTER is before the Court sua sponte. The Court previously granted, in part, Petitioner's habeas petition and ordered Respondents to afford Petitioner with an individualized bond hearing pursuant to 8 U.S.C. § 1226(a). (DE 9 ).
