ORDER denying 6 Motion for TRO; denying 8 Motion to Expedite; denying 8 Motion. ORDER. Petitioner's 6 Emergency Motion for Temporary Restraining Order (T.R.O.) and his 8 Motion to Expedite Proceedings and Request for Immediate Relief are DENIED. At the outset, the Court notes that Petitioner has counsel in this matter, but he filed the Motions at ECF Nos. 6 and 8 pro se. He also filed a Motion for Appointment of Counsel at ECF No. 7. The Court assumes without deciding that it may properly address the pro se Motions at ECF Nos. 6 and 8 while Petitioner is represented by counsel because the Court must deny those Motions in any event. Further, the Court stresses that it is not currently resolving the Motion at ECF No. 7. Turning to Petitioner's Motion for a T.R.O., he seeks two forms of relief--immediate release or an immediate bond hearing. (ECF No. 6 at 3). Both of those items would go beyond the "limited nature of a [T.R.O.,]" and would instead constitute "mandatory, affirmative relief[,]" which may not be afforded via a T.R.O. Hope v. Warden York Cty. Prison, 956 F.3d 156, 16162 (3d Cir. 2020) (finding that where the district court purported to enter an ex parte T.R.O. but directed the release of twenty petitioners, the "relief altered the status quo, exceeding the temporary and limited nature of a [T.R.O.]") (citing Granny Goose Foods Inc. v. Brotherhood of Teamsters and Auto Truck Drivers Local, 415 U.S. 423, 439 (1974)). Accordingly, the Court DENIES Petitioner's Motion at ECF No. 6. Turning to the Motion at ECF No. 8, the Court has already set a heavily expedited briefing schedule in this matter, (ECF No. 2), rendering Petitioner's request for expedited review moot. And the Court has explained in the previous paragraph why, even assuming without deciding that the Court will ultimately order a bond hearing, it will not afford Petitioner relief at this moment in this case. Therefore, the Court DENIES Petitioner's Motion at ECF No. 8. Counsel for Petitioner shall apprise him of this Text Order. Given the status of the issue of counsel in this matter, and as a precaution, the Clerk shall also mail this Text Order to Petitioner at the address set forth on the envelope at ECF No. 6-1.
