ORDER OF COURT. IT IS HEREBY ORDERED that the pro se 3 Petition for Writ of Habeas Corpus is DISMISSED. Petitioner has a counseled Petition for Writ of Habeas Corpus under 28 U.S.C. § 2241 pending at Case No. 3:26-cv-00907 in the United States District Court for the Western District of Texas raising essentially the same claims that he is attempting to litigate in this district. In sum, both petitions challenge the legality of Petitioner's detention and seek his immediate release or, in the alternative, a bond hearing. While Petitioner has been transferred to an immigration detention center within the Court's jurisdiction, the Western District of Texas continues to retain jurisdiction over his first habeas petition. Petitioner cannot litigate the same claims in two forums. The habeas petition before the Court is duplicative of claims already pending at Case No. 3:26-cv-00907 in the United States District Court for the Western District of Texas.
