Pursuant to Fed. R. Civ. P. 65(b), a court may issue a TRO without written or oral notice to an adverse party only if "specific facts in an affidavit or a verified complaint clearly show that immediate and irreparable injury, loss, or damage will result to the movant before the adverse party can be heard in opposition" and "the movant's attorney certifies in writing any efforts made to give notice and the reasons why it should not be required." Petitioner has filed an affidavit that fails to identify specific facts demonstrating why the Emergency Motion for TRO must be ex parte and why Respondents cannot respond on an expedited briefing schedule. The Court has previously ordered Respondents to respond to Motions for TRO on such expedited schedules in this case and similar cases. Thus, the Petitioner's request for issuance of an ex parte TRO is DENIED. Because the District of Colorado is not the district of Petitioner's current confinement, the Court raises the question of whether it has jurisdiction to weigh the merits of Petitioner's claims. The parties are ORDERED TO SHOW CAUSE by Friday, March 20, 2026 at noon MST as to why this Court does or does not have jurisdiction to weigh the merits of Petitioner's claims in Emergency Motion for Temporary Restraining Order 30 and Emergency Motion to Enforce the Court's Order, ECF No. 23, and Final Judgment, ECF No. 28, Granting Release 31 . ORDER. "[F]or core habeas petitions challenging present physical confinement, jurisdiction lies in only one district: the district of confinement." Rumsfeld v. Padilla, 542 U.S. 426, 443 (2004). This Court granted Petitioner's requested habeas relief, and she was released from custody in the District of Colorado on November 26, 2025. At this point, her "present physical confinement" in the District of Colorado ended. Petitioner then moved to Texas and was re-detained in the Western District of Texas. Given the Western District of Texas is her new district of confinement, this Court does not have jurisdiction to weigh the merits of her claims in the Emergency Motion for Temporary Restraining Order 30 or Emergency Motion to Enforce the Court's Order and Judgment 31 . Accordingly, the Emergency Motion for Temporary Restraining Order 30 and Emergency Motion to Enforce the Court's Order and Judgment 31 are DENIED. SO ORDERED by Judge Regina M.
