Judge Brian E. Murphy: ELECTRONIC ORDER entered. Respondents concede that “applicable regulations allow a second bond hearing before an immigration judge on a non-citizen’s request ‘upon a showing that the [non-citizen’s] circumstances have changed materially since the prior bond redetermination,’” Dkt. 12 at 3 (quoting 8 C.F.R. § 1003.19(e)), and assert that “Respondents would not oppose the motion,” id. The Court construes the Petition, along with the submission of evidence that post-dates the first bond hearing and calls into question the propriety of relying on the interpol notice as evidence of flight risk, see Dkts. 1 -4, 1 -5, as a request for a bond redetermination. See Dkts. 1 at 18–19, 1 -4, 1 -5. Accordingly, the Petition is GRANTED in part and the Court ORDERS that Petitioner receive a bond hearing under 8 U.S.C. s. 1226 to consider the merits of his release. Petitioner’s motion to substitute counsel, Dkt. 8, is DENIED as moot. (MBM) (Entered: 04/21/2026)
