District Judge Leo T. Sorokin: ELECTRONIC ORDER entered.Jhorman Argenis Rojas Medina, representing himself, has filed a petition pursuant to 28 U.S.C. 2241 challenging his detention by the respondents following an arrest by CBP and subsequent transfer into ICE custody. Doc. No. 1. Rojas Medina alleges that his warrantless arrest violated his rights under the Constitution and federal immigration statutes, and that his detention without cause, without notice, and without a finding by a neutral decisionmaker that he is a danger or a flight risk is unlawful. The respondents do not contest the facts alleged by Rojas Medina. See Doc. No. 10. They incorporate their legal arguments from prior cases, in which they defended the relevant noncitizens’ continued detention by claiming it was permitted (and, indeed, mandated) by 8 U.S.C. 1225. As the Court concluded in those cases, and on the facts alleged here, Rojas Medina is not subject to mandatory detention under Section 1225. His petition is therefore ALLOWED. Two reasons cause the Court to impose a different remedy than imposed in many previous cases. First, the record contains no warrant invoking Section 1226, unlike the records in the cases the respondents cite. Indeed, Rojas Medina alleges a warrantless arrest, and the respondents do not dispute that allegation. Second, the government has not otherwise asserted that it arrested or is detaining Rojas Medina under Section 1226. The respondents may not detain him under Section 1225, the only advanced basis for detention. Accordingly, the respondents shall RELEASE Rojas Medina no later than 6 PM today (April 15, 2026), and they shall not retaliate against him for the filing of this habeas petition. The respondents shall file a status report tomorrow, April 16, 2026, confirming that Rojas Medina has been released in compliance with this Order.(FGD) (Entered: 04/15/2026)
