SCHEDULING NOTICE by Judge Fred W. Slaughter: The court is in receipt of Ex Parte Application for Temporary Restraining Order. (Dkts. 2, 4, 5 ("Application").) The court has also received an Opposition to the Application. (Dkt. 7 .) The court observes that the Application appears not to be supported by a declaration as required under Local Rule 65-1. (See generally Dkt.; see also C.D. Cal L.R. 65-1). The court notes the Petition, that serves a basis for the Application, in summary, is filed as a Petition for Writ of Habeas Corpus, under 28 U.S.C. § 2241, and requests for declaratory relief, injunctive relief, and set aside relief under the Administrative Procedure Act. (See Dkt. 1.) The court has concerns regarding the lack of a declaration in support of the Application and the issue of venue in light of the record. Accordingly, the court ORDERS supplemental briefing of no more than 5 pages from each party regarding the following: (1) if the TRO should be denied based on Petitioner's non-compliance with C.D. Cal L.R. 65-1; and (2) whether venue in the Central District of California is appropriate under 28 U.S.C. § 2241 based on the custodial housing location of Petitioner, see Rumsfeld v. Padilla, 542 U.S. 426 (2004); Hernandez v. Campbell, 204 F.3d 861 (9th Cir. 2000). The parties shall file supplemental briefing on or before November 4, 2025, at 1:00 p.m. No oppositions or replies to the supplemental briefing is permitted. The court sets an in-person hearing on the Application on Wednesday, November 5, 2025, at 1:00 p.m., in Courtroom 10D, with all counsel ordered to appear for the in-person hearing.
