MINUTE ORDER IN CHAMBERS by Judge Mark C. Scarsi: ORDER TO SHOW CAUSE RE DISMISSAL OR TRANSFER. Petitioner Wenliang Liu brings this action for a writ of habeas corpus. (Pet., ECF No. 1.) The petition states that Petitioner is detained at the California City Corrections Center. (Pet. 2.) California City is located within Kern County, California, which is in the territorial jurisdiction of the United States District Court for the Eastern District of California-not this Court. The Court orders Petitioner to show cause why the action should not be dismissed or transferred to the United States District Court for the Eastern District of California. Petitioner shall respond in writing within seven days. Failure to timely and satisfactorily respond will result in dismissal or transfer of this case without further warning. MINUTE ORDER IN CHAMBERS by Judge Mark C. Scarsi: ORDER TRANSFERRING CASE. Petitioner Wenliang Liu brings this action for a writ of habeas corpus. (Pet.,ECF No. 1.) The Court ordered Petitioner to show cause why this action should not be dismissed or transferred given the petition's allegation that Petitioner is not detained in the territorial jurisdiction of this Court. (OSC, ECF No. 4; Pet. 2.) The Court warned that "[ f]ailure to timely and satisfactorily respond will result in dismissal or transfer of this case without further warning." (OSC 1-2.) Petitioner did not file a response. The Court treats Petitioner's failure to respond as a concession that Petitioner is detained within the territorial jurisdiction of the United States District Court for the Eastern District of California and that this Court lacks jurisdiction. Rumsfeld v. Padilla, 542 U.S. 426, 443 (2004). Accordingly, the Court orders that this action be transferred to the United States District Court for the Eastern District of California,where Petitioner was detained at the time of filing the petition. 28 U.S.C. § 1406(a). MINUTE ORDER issued by Courtroom Deputy for Magistrate Judge Allison Claire on 04/15/2026. Petitioner, Wenliang Liu (A# 245-100-128), a self-represented immigration detainee, filed a petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2241. Based on the length of time in which petitioner has been in immigration detention, the court hereby authorizes petitioner to proceed in forma pauperis without prepayment of the filing fee in this action. See 28 U.S.C. § 1914. Because petitioner may be entitled to the requested relief if the claimed violations are proved, respondent will be served with the § 2241 petition and directed to show cause why the writ should not be granted by filing an answer/return. See 28 U.S.C. § 2243. The Clerk of the Court shall serve a copy of this order together with a copy of petitioner's application for a writ of habeas corpus pursuant to 28 U.S.C. § 2241 on the United States Attorney. Respondents are directed to file an answer/return within 14 days from the date of this order. If respondents dispute any factual representations in the operative petition, they shall include with the answer/return any and all documents necessary to support their view of the facts. Petitioner's reply/traverse, if any, is due within 7 days of being served a copy of the respondents' answer/return. Respondent shall NOT TRANSFER petitioner outside of this judicial district, pending further order of the court. See 28 U.S.C. § 1651(a) (establishing the All Writs Act which empowers the federal courts to "issue all writs necessary or appropriate in aid of their respective jurisdictions...."); see also F.T.C. v.
