TEXT ORDER: The Court is in receipt of the Petition. It appears that Petitioner asserts a single claim seeking to prevent his allegedly unlawful transfer in violation of the Due Process Clause and the Suspension Clause. At the same time, however, Petitioner requests relief in the form of his immediate release from custody. Because the Petition is unclear as to the precise nature of Petitioner's claim and the relief sought, the Court will require Petitioner to provide a more definite statement pursuant to Rule 12(e) of the Federal Rules of Civil Procedure. See Alston v. Parker, 363 F.3d 229, 234 n.7 (3d Cir. 2004) ("[T]he District Court on its own initiative, may [seek] a more definite statement to resolve any ambiguity or vagueness."); Fed. R. Civ. P. 81(a)(4) (federal rules of civil procedure "apply to proceedings for habeas corpus"); Rule 12, Rules Governing §§ 2254 & 2255 Cases (federal rules of civil procedure apply in habeas cases "to the extent that they are not inconsistent with any statutory provisions or [the habeas] rules"). Petitioner's amended petition shall be filed within seven (7) days of this Order. The Court's no-transfer Order, (ECF No. 3), shall remain in full effect until further order of the Court.
