Minute Order by Judge Jinsook Ohta: Petitioner filed this petition for writ of habeas corpus under 28 U.S.C. § 2241 on January 7, 2026, naming the Warden of the Otay Mesa Detention Center as respondent. Dkt. 1. Respondent represents that Petitioner was transferred to the South Louisiana ICE Processing Center on January 5, 2026, and subsequently removed to Columbia on January 30, 2026. Dkts. 8, 9. In a habeas action challenging present physical custody, the proper respondent is the petitioner's immediate custodian, and jurisdiction lies in the district of confinement. Rumsfeld v. Padilla, 542 U.S. 426, 434-35 (2004). Because Petitioner was confined in Louisiana when the petition was filed and the named respondent is not Petitioner's immediate custodian, this Court lacks jurisdiction. In the interest of justice, the Court VACATES the March 12, 2026 hearing and TRANSFERS this action to the United States District Court for the Western District of Louisiana pursuant to 28 U.S.C. § 1631.
