ORDER: Petitioners A.B.D's and C.C.S.'s Petition for Writ of Habeas Corpus is GRANTED, ECF No. 1 . The Court is in receipt of Respondents' Notice of Statutory Basis for Petitioners' Detention, ECF No. 24, which provides that Petitioners are detained under 8 U.S.C. § 1225(b)(2). Respondents do not have authority to detain Petitioners under 8 U.S.C. § 1225(b)(2). Although Petitioners were released from detention at the Northwest ICE Processing Center in Tacoma, Washington, on October 31, 2025, ICE placed Petitioners in ankle monitors and requires A.B.D. to attend mandatory ICE check-ins. Petitioners are thus still in Respondents' custody. Under 28 U.S.C. § 2241(c)(3), federal courts have authority to grant writs of habeas corpus to individuals "in custody in violation of the Constitution or laws or treaties of the United States." 28 U.S.C. § 2241(c)(3). Custody is not limited to physical imprisonment. A court may afford habeas relief to an individual, who, as here, is subject to "restraints not shared by the public generally." Jones v. Cunningham, 371 U.S. 236, 240 (1963); see also Munoz v. Smith, 17 F.4th 1237, 1241 (9th Cir. 2021) (holding that custody "encompass[es] circumstances in which the state has imposed 'significant restraints on [a] petitioner's liberty'") (quoting Jones, 371 U.S. at 373). Ankle monitors and mandatory check-ins are not restraints shared by the public generally. They impose significant restraints on A.B.D.'s and C.C.S.'s liberty. Respondents must immediately release Petitioners from ankle monitors and required check-ins and may not re-detain Petitioners. Respondents must provide the Court proof of Petitioners' release from ankle monitors and required check-ins within twenty-four hours of this Order. Ordered by Judge Ann L. Aiken.
