Kasubhai: The Court has preliminarily considered the evidence presented on the Petition for Writ of Habeas Corpus and is inclined to grant the petition at least as it relates to Claims 5 and 6. Therefore, the Court is also inclined to receive and consider the Petitioner's Motion to Amend the Petition and for Class Certification. As the Court assured Respondents at the hearing, they may now file an advisory brief explaining their position as to why it would nevertheless be prudent to stay Petitioner's motions.
