TEXT ORDER: The Court having reviewed Petitioner's habeas petition in this matter, the Government is ORDERED to show cause within seven days why Petitioner should not be ordered released from custody pursuant to this Court's decisions in Valerio v. Joyce, No. 25-17225, 2025 WL 3251445 (D.N.J. Nov. 21, 2025), Hueso v. Soto, No. 26-1455, 2026 WL 539271 (D.N.J. Feb. 26, 2026), and Fajardo-Nugra v. Soto, No. 26-975, 2026 WL 579192 (D.N.J. Mar. 2, 2026). Petitioner may file a reply within three days of the date on which the Government files its response to this Order. The Government shall not transfer petitioner to a facility outside of New Jersey until this matter concludes. In addition to what is set out above, a declaration from ICE shall also be filed. It shall indicate that ICE has (i) received this Court's Order prohibiting Petitioner's transfer from New Jersey; and (ii) received written legal advice from the United States Attorney's Office on the subject of ICE's obligation to comply with that Order. The declaration shall be filed on the public docket of the Court on or before 5:00 p.m. on April 8. The declaration must be executed by either the Newark ICE Field Office Director or by the Newark ICE Field Office Deputy Director. The declaration may be signed by hand or electronically. Finally, the United States Attorney's Office shall immediately file a letter on the Court's public docket if an Order of the Court is violated in connection with this case. Petitioner shall be released in accordance with this Court's Order by 5 p.m. on April 22. The Court is not satisfied with the Government's explanation for the current situation, however. TEXT ORDER that the Court has reviewed the Declarations 13, 14 submitted by DHS and the U.S. Attorney's Office with respect to Petitioner's transfer out of New Jersey prior to the Court's issuance of its Orders. Those Orders barred the transfer and required the U.S. Attorney's Office to immediately report any violations of those Orders, orders that have routinely been issued to both agencies. The Court is dismayed that while both agencies may have technically complied with the letter of the Orders' instructions, the spirit of those Orders was ignored. Specifically, DHS failed to inform the Court that it had transferred Petitioner prior to the entry of the Court's injunction knowing that this Court's intent was to maintain the status quo and ensure its ability to provide timely relief to Petitioner, which was directly hampered by DHS's silence as to the pre-injunction transfer. And the U.S. Attorney's Office failed to discern the issue and inform the Court on its own of such action knowing the Court's intent. The Court is mindful that DHS and the U.S. Attorney's Office will require even more explicit guidance going forward to protect the rights of Petitioners in these cases. So Ordered by Judge Zahid N.
