TEXT ORDER: The Court has reviewed the Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 (ECF No. 1 ) filed by Petitioner, Francisco Perez Vasquez, who is presently detained at Delaney Hall Detention Facility in Newark, New Jersey. Petitioner, a citizen of Guatemala, alleges that he entered the United States without inspection approximately 18 years ago and has resided here since. Petitioner further represents that he was detained by Immigration and Customs Enforcement following completion of a scheduled interview with an asylum officer on April 8, 2026. Petitioner contends that his detention pursuant to 8 U.S.C. § 1225(b) is unlawful and violates the Due Process Clause of the Fifth Amendment. Accordingly, it is ORDERED that Respondents shall SHOW CAUSE, on or before April 15, 2026, why the Petition should not be granted. Petitioner may file a reply within three (3) business days after Respondents file their response. Petitioner shall serve a copy of this Order and the Petition upon Respondents within two (2) business days of the entry of this Order and shall promptly file proof of service on the docket. TEXT ORDER: This matter comes before the Court upon a Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241. The Court has reviewed the Petition (ECF No. 1), the Response (ECF No. 6), and the Reply (ECF No. 7) and finds that Petitioner is detained pursuant to 8 U.S.C. § 1226(a), which requires an individualized bond hearing. Accordingly, the Petition is GRANTED IN PART. This Text Order amends the Court's formal Order entered on May 19, 2026, to clarify that the relief granted is limited to an individualized bond hearing pursuant to 8 U.S.C. § 1226(a), and does not direct Petitioner's release. It is on this day of May 20, 2026, ORDERED that Respondents shall provide Petitioner with an individualized bond hearing pursuant to 8 U.S.C. § 1226(a) within seven (7) days of the date of this Order, and it is further ORDERED that within three (3) days of the bond hearing, Respondents shall file a letter advising the Court of the outcome upon which the Court will close this matter absent further relief being warranted. TEXT ORDER: In light of the Court's Amended Order (ECF No. 9) limiting relief to an individualized bond hearing pursuant to 8 U.S.C. § 1226(a), and for good cause shown, It is ORDERED that Petitioner shall appear for an individualized bond hearing before the Immigration Court on a date to be scheduled by Respondents and/or the Executive Office for Immigration Review. Respondents shall promptly provide notice to Petitioner of the date, time, and location of the bond hearing. It is further ORDERED that Petitioner shall comply with all directives concerning his appearance at the bond hearing and any related immigration proceedings. The Court shall retain jurisdiction pending completion of the bond hearing and any application for further relief arising from Petitioner's failure to appear or the implementation of the Court's Amended Order.
