MINUTE entry before the Honorable Sharon Johnson Coleman: Motion hearing held on 4/16/2025. Plaintiff filed a Complaint 1 for habeas corpus, declaratory judgment, and injunctive relief stemming from Defendants' termination of Plaintiff's Student and Exchange Visitor Information Systems ("SEVIS") record. Plaintiff alleges that U.S. Immigration and Customs Enforcement ("ICE") through the Student and Exchange Visitor Program ("SEVP") uses SEVIS to monitor international students' compliance with their F-1 visa status. Plaintiff contends that SEVP terminated Plaintiff's SEVIS record with the stated reason of "Other Individual identified in criminal records check and/or has had their VISA revoked." Plaintiff alleges that he does not have a criminal record nor has he violated, nor received notice of, revocation of his F-1 visa. Plaintiff filed a Motion for Temporary Restraining Order 8 requesting the Court enjoin Defendants from terminating his SEVIS record, and requiring them to reactivate his SEVIS record so he may resume his Optional Practice Training ("OPT") and enjoin Defendants from detaining him and transferring him outside the jurisdiction of this Court. The motion was presented to the Court on 4/16/25. After brief oral argument, Defendants requested time to respond to the motion. Defendants to respond by 4/17/25 at 5 p.m. CST. Plaintiff to reply by 4/18/25 at 5 p.m. Once fully briefed, the Court will take the motion under advisement. During the pendency of the motion, the Court orders the Plaintiff may not be moved anywhere, outside of this Court's jurisdiction, and Plaintiff may not be detained for immigration purposes in any way, shape or form. The Court sets this matter for status on 4/21/25 at 8:45 a.m. CST. The Court directs Plaintiff to properly serve the Complaint and motion to Defendants. Mailed notice.
