IT IS FURTHER ORDERED that on or before 11/05/225 Respondents shall provide to putative class counsel in the above three actions the names, A numbers, and dates of detention regarding the 185 detainees identified by DHS as applicants for admission subject to the mandatory detention under § 1225(b)(2). Respondents shall provide the same information for the remaining 410 detainees identified by DHS as soon as feasible, on a rolling basis. IT IS FURTHER ORDERED that on or before 11/07/25, Respondents shall provide a list of how the sources of the requested information for each detainee are stored, accessed, and maintained, including but not limited to any arrest warrant, NTA, Form-286, and Form I-213, whether stored electronically, within the E-Cast system, or otherwise. Respondents shall also provide an exemplar of how these documents are stored for an individual detainee for the Courts review. IT IS FURTHER ORDERED that a status conference is set for 11/13/25 at 10:30 a.m., in LV Courtroom 7C, in all three putative class actions. IT IS FURTHER ORDERED that at least one representative from DHS/ICE who can describe how the agency identified the 185 detainees and how the requested information is stored, maintained, and retrieved shall appear at the 11/13/25 status conference. The parties shall be prepared to finalize a discovery and certification briefing schedule for all three putative class actions, which will be consolidated for purposes of pre-certification discovery, at the status conference. MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 12/4/2025.The Court has reviewed the 41 Joint Status Report filed by the parties in compliance with this Court's 35 Order. The Court is alarmed to learn that Plaintiff Guevara-Alcantar was ordered released on bond December 1, 2025 by IJ Daughtery, but remains in detention despite multiple attempts by his family members to pay the bond using ICE's online portal, when after each attempt they received an error message stating "there are no matching or no releasable aliens for this bond payment request." See ECF No. 41 at 3. Defendants assert that bond must be paid in person due to unspecified "limitations on disclosure of information due to privacy issues which prohibit acceptance of the bond online" and additional information regarding these privacy issues has been requested by Plaintiffs' counsel. Id.The Court finds that Defendants' failure to expediently accept the bond payment by Plaintiff Guevara-Alcantar is unlawfully prolonging his detention. This prolonged detention is inconsistent with the Court's intent in its 35 Order that Plaintiff Guevara-Alcantar be released immediately upon the granting of bond.Therefore, IT IS HEREBY ORDERED that Mr. Guevara-Alcantar be IMMEDIATELY RELEASED from Defendants' custody. Mr. Guevara-Alcantar shall have until January 19, 2025 to satisfy the bond conditions. IT IS FURTHER ORDERED that Defendants shall file a notice of compliance with this Order no later than 5:00 p.m. TODAY, December 4, 2025. Plaintiffs are to develop a proposal for the Courts consideration for contact with potential class members; obtaining preliminary or individual relief on behalf of class members pending the issuance of final class wide relief; and/or for individual class members to obtain preliminary relief in the current action or through joint separate habeas petitions. IT IS ORDERED Respondents shall continue to supply a weekly list of detainees and corresponding documents to class counsel as previously ordered by the Court. The Court finds this information continues to be necessary and material post-certification to allow class counsel to identify class members and ensure notice is provided to class members pursuant to Federal Rule of Civil Procedure 23(d)(1)(B) IT IS FURTHER ORDERED that Respondents' counsel shall ensure class counsel can access the documents produced as of 2/18/2026. Class counsel will then review the documents provided and determine what, if any, additional information is needed from Respondents to determine whether the detainees listed weekly by Respondents are class members. IT IS FURTHER ORDERED Ashlee Hesman and Jacob Lee are granted a standing order to appear remotely at all immigration hearings in which they are counsel for the detention facility(s), so long as they contact the courtroom administrator at least 48 hours prior to the hearing. This matter is continued to Thursday, February 26, 2026 at 1:45 p.m. IT IS FURTHER ORDERED that the deadline for the parties to file a joint proposed scheduling order and discovery plan is STAYED pending resolution of outstanding issues at the February 26, 2026 status conference. Boulware, II on 3/13/2026.The Court is in receipt of Federal Defendants-Respondents' 91 Motion for Leave to Submit Declaration in Lieu of Live Testimony, or in the Alternative, for Clarification.The Court DENIES the Motion IN PART in so far as it seeks leave to submit a declaration in lieu of live testimony. The Court requires the agency official most knowledgeable to be available for questioning by the Court and Class Counsel at the 3/16/2026 Status Conference.The Court GRANTS the Motion IN PART to the extent it seeks clarification regarding the scope of information the Court will address at the 3/16/2026 Status Conference. The designated agency official will be asked to address: (1) the availability (electronically or otherwise) of the following documents for all detainees included in the weekly detainee lists: (i) Form I-213s and (ii) either Form I-862s (NTAs) or a list of charges of removability; AND(2) how those documents can be timely produced with the weekly detainee lists going forward. The Court notes that in a similar regional class action in the Western District of Washington, the district court ordered the weekly production of the above documents with detainee lists to class counsel, and Federal Respondents have since complied without issue. See Rodriguez Vazquez v. Hermasillo, No. 3:25-cv-05240-TMC, ECF No. 116. The Court will discuss how to proceed regarding the remaining information contemplated at the March 6, 2026 Hearing, including but not limited to the possibility of Class Counsel obtaining access to information regarding Class Members' custody determinations and redeterminations, whether through the EOIR ECASS system or by other means, at the March 16, 2026 Status Conference. IT IS ORDERED Defendants-Respondents Radar and Balaam shall file their responses to Plaintiffs-Petitioners 106 Amended Petition on or before May 4, 2026. The responses should address any reason why these Defendants-Respondents should not be included in this action or be bound by the Courts orders in this action. Because the 106 Amended Petition does not make substantive changes as it pertains to Federal Defendants-Respondents and Defendant-Respondent Mattos, these parties need not file responses to the 106 Amended Petition; instead, the Court incorporates their prior responses. The Court hears from Federal Defendants-Respondents counsel as to any objections regarding the 108 Proposed Notice. For the reasons stated on the record, which are incorporated by reference herein, Federal Defendants-Respondents' objections are OVERRULED by the Court. IT IS FURTHER ORDERED Plaintiffs-Petitioners shall file finalized versions of the following three documents by Monday, April 20, 2026: (1) Class Notice; (2) Membership Inquiry Form; (3) (Pro Se) Habeas Petition. The Class Notice and Membership Inquiry Form shall be provided in both English and Spanish. The Court anticipates issuing an order approving these forms for dissemination soon after receiving the finalized versions. The Court clarifies that, once approved via Court order, a packet of these forms (English and Spanish versions of the Class Notice, English and Spanish versions of the Membership Inquiry Form, and English and Spanish versions of the template habeas petition, but not the forms included in the Courts 96 Order) are to be provided to all individuals being held in immigration detention in the District of Nevada, EXCEPT (i) individuals with final orders of removal and (ii) individuals who were inspected and lawfully admitted to the United States, as agreed upon by the Parties on the record, which is incorporated herein. More details will follow in the Courts Order approving the notice and forms. IT IS FURTHER ORDERED Defendant-Respondent Mattos shall file a status report by April 24, 2026, confirming the locked drop-box has been installed at NevadaSouthern Detention Center to effectuate form collection, including signage on the drop-box to identify the limited nature and use of the collection box, as discussed on the record. IT IS FURTHER ORDERED Plaintiffs-Petitioners are INSTRUCTED to meet and confer with counsel for Defendant-Respondent Mattos to determine collection times. The collections must occur, at minimum, on a weekly basis. The Courts prior 99 and 105 Orders requiring Federal Defendants-Respondents to provide class counsel weekly information regarding potential class members including the weekly detainee list every Monday, corresponding Form I-213 data, out date data, and detention center transfer data, every Wednesday, REMAIN IN EFFECT. See ECF Nos. 99 and 105 for further details. IT IS FURTHER ORDERED every Wednesday Federal Defendants-Respondents must provide class counsel with information regarding the reasons why individuals have been removed from the previous weeks detainee list, including whether they have been (i) released from custody, whether on bond or otherwise; (ii) removed from the country; or (iii) transferred to detention centers outside of the District of Nevada. IT IS FURTHER ORDERED that Federal Defendants-Respondents must file a notice to the Court by April 22, 2026 indicating, as of April 17, 2026, (i) how many individuals were in immigration detention in the District of Nevada and (ii) how many of those individuals are subject to a final order of removal. IT IS FURTHER ORDERED Federal Defendants-Respondents shall file with the Court, by 5:00 PM April 22, 2026, a signed declaration from a representative of Defendant-Respondent Executive Office for Immigration Review (EOIR) confirming (or denying) that all active immigration judges in the District of Nevada (i) have received the Courts 97 Order and (ii) are in compliance with said 97 Order. IT IS FURTHER ORDERED Federal Defendants-Respondents shall provide, at the next status conference, clarification regarding the process for noncitizens arrested out-of-state and detained in Nevada, as discussed on the record. Specifically, Federal Respondents must provide information as to whether these individuals are taken directly to a detention center within the District or to Federal Justice Tower for processing. IT IS ORDERED the deadline for compliance by Defendants-Respondents Balaam and Radar is EXTENDED until 4/29/2026. The Court discusses the 129 Declaration by Assistant Chief Immigration Judge for the Las Vegas Immigration Court Jonathan Hitesman (" ACIJ Hitesman"), representative for Defendant-Respondent Executive Office for Immigration Review ("EOIR"), noting it attests "All Immigration Judges at the Las Vegas Immigration Court and all Immigration Judges who preside over cases at the Reno, Nevada hearing location have read and understand the March 30, 2026 Order Granting Partial Summary Judgment" but fails to attest the immigration judges are in compliance with the 96 Order, as ordered by the Court. See ECF No. 121 . Federal-Respondents are reminded any legal objections to this Court's 96 Order and 97 Judgment by Defendant-Respondent EOIR or its agents must be timely raised before this Court. Therefore, IT IS ORDERED that Federal-Respondents must submit a declaration by ACIJ Hitesman attesting that all immigration judges in the District of Nevada are in compliance with the Court's 96 Order and 97 Judgment by 5/1/2026. The Court hears from Plaintiffs-Petitioners as to their unopposed request to stay discovery on the remaining class claims pending the Ninth Circuit's decision in Rodriguez Vazquez v. Bostock, et al., No. 25-6842 (9th Cir.). IT IS ORDERED the requested stay of discovery is GRANTED. However, the parties are instructed to discuss the anticipated scope of discovery requests in the event Plaintiffs-Petitioners' remaining claims proceed. Counsel for Plaintiffs-Petitioners raises proposed briefing schedule on Defendants-Respondents' 128 Motion for Reconsideration. IT IS ORDERED Plaintiffs-Petitioners response is due by 5/1/2026. Federal Defendants-Respondents' reply is due by 5/8/2026. Counsel for Plaintiffs-Petitioners report on ongoing discussions with Warden Defendants-Respondents for retrieval of forms pursuant to the 127 Order and ability to interview Class Members. Class Counsel is advised to file an appropriate motion in the event they seek court intervention regarding any dispute as to Class Counsel access to detained Class Members. IT IS ORDERED that class counsel is granted leave to file joint habeas petitions on behalf of up to fifteen (15) Class Members for the sake of efficiency. See, e.g., Dominguez v. Hermosillo, No. 2:25-CV-02337-TMC, 2025 WL 3537627 (W.D. Wash. Dec. 10, 2025) (adjudicating joint habeas petitions by members of Bond Denial Class seeking relief pursuant to Rodriguez v. Bostock, 802 F. Supp. 3d 1297 (W.D. Wash. 2025)). IT IS ORDERED that counsel for Defendants-Respondents Balaam and Radar are granted leave to appear remotely at all future proceedings in this matter. MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 4/30/2026.The Court is in receipt of Plaintiffs-Petitioners' ("Plaintiffs") 136 Emergency Motion, which seeks an order precluding transfer of 25 potential Class Members from this district, to allow counsel for Plaintiffs ("Class Counsel") to receive and review documents relating to those individuals and file group habeas petitions on their behalf, if after review, Plaintiffs conclude the individuals are eligible for relief pursuant to the Court's classwide judgment in this case. To preserve its own jurisdiction over their claims, the Court temporarily STAYS the scheduled transfer of the 25 individuals identified in the 136 Emergency Motion beyond the United States District of Nevada. This Court has "express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction." F.T.C. v. Dean Foods Co., 384 U.S. 597, 608 (1966); Al Otro Lado v. Wolf, 952 F.3d 999, 1007 n.6 (9th Cir. 2020) ("Having concluded that [agency action] would interfere with the courts jurisdiction..., the district court properly issued an injunction under the All Writs Act.") (citing 28 U.S.C. §1651(a)). The Court finds such an injunction, in the form of a temporary stay on transfer, is appropriate here. The Supreme Court has repeatedly held that only one district has jurisdiction over a "core habeas petition:" "the district of confinement." Trump v. J.G.G., 604 U.S. 670, 672 (2025) (citing Rumsfeld v. Padilla, 542 U.S. 426, 443 (2004)). Were these potential Class Members removed from the District of Nevada before they can file petitions for appropriate relief, this Court would likely lose jurisdiction over their claims. Further, this Court has inherent authority to enter a brief administrative stay that affords itself time to assess its jurisdiction over these potential Class Members' claims. See, e.g., United States v. Shipp, 203 U.S. 563, 573 (1906) ("Until its judgment declining jurisdiction should be announced, [a court] ha[s] authority, from the necessity of the case, to make orders to preserve the existing conditions and the subject of the petition."); Belbacha v. Bush, 520 F.3d 452, 455-46 (D.C. Cir. 2008) (under 28 U.S.C. §1651); see also Nat'l Council of Nonprofits v. Off. of Mgmt. & Budget, 763 F. Supp. 3d 13, 17 (D.D.C. 2025) (collecting examples of temporary administrative stays issued by district courts pursuant to "the All Writs Act and a court's inherent authority to manage its docket.") Therefore, IT IS HEREBY ORDERED that Defendants-Respondents are ENJOINED from transferring the 25 individuals identified in the 136 Emergency Motion outside of the District of Nevada until May 7, 2026, or further order of the Court. IT IS FURTHER ORDERED that Federal Defendants-Respondents must produce the I-213 documents for potential Class Members Cruz-Blandon and Varela Gaucin, as identified in Plaintiffs' 136 Motion, by May 4, 2026.IT IS FURTHER ORDERED the appropriate facility Defendants-Respondents, must facilitate Class Counsel's ability to communicate with the potential Class Members identified in the 136 Motion to enable them to expeditiously petition for appropriate relief. IT IS FURTHER ORDERED that the Court's 127 ORDER requiring Notice to Class Members and Class Counsel is AMENDED as follows: Federal Defendants shall provide the following notice to class counsel on an ongoing basis: notice within 48 hours prior to any transfer of a Class Member outside of the District of Nevada even if that Class Member has yet to file a habeas petition. Smith; Pla Counsel: Sadmira Ramic, Michael Kagan, Sylvia Irvin and Wendi Overmyer; Def Counsel: Tamer Botros; Court Reporter: P. Eaker; Time of Hearing: 8:10 - 9:10; Courtroom: 7C; The Court makes preliminary remarks and hears from parties regarding the ongoing submission and processing of notice, inquiry, and template forms by potential Class Members. The parties apprise the Court of their plan to meet and confer next week regarding their anticipated discovery plan and scheduling order upon the Ninth Circuits decision in Rodriguez v. Bostock, No. 25-6842 (9th Cir.), in the event Plaintiffs-Petitioners' due process and arbitrary and capricious claims will proceed. With regards to individual petitions by Class Members, the Court instructs the parties that incorporation by reference to previous briefing is permitted on the statutory and regulatory issues resolved in the Courts 96 Order Granting Partial Summary Judgment. However, the remaining due process and arbitrary and capricious claims have not been adjudicated on the merits and therefore must be fully briefed in individual petitions. Plaintiffs-Petitioners are granted leave to file amended Joint Class Member Petitions in Case Nos. 2:26-cv-01366; 2:26-cv-01367; 2:26-cv-01365. The Court will issue scheduling orders upon filing. The Court hears from Counsel for Federal Defendants-Respondents as to delays in receiving documents relevant to Class Members detention from ICE/DHS in individual habeas matters. The Court finds these documents (other than transcripts and recordings of custody redetermination proceedings) should already be collected and readily available upon an individuals arrest and detention and therefore DECLINES to grant a uniform extension of the three-day statutory deadline set forth in 28 U.S.C. § 2243 without an individualized showing of good cause. See 28 U.S.C. § 2243 (requiring a return "within three days unless for good cause additional time, not exceeding twenty days, is allowed."). Counsel for Federal Defendants-Respondents is advised to impress upon his agency client that the agency should have these documents for ALL individuals in their custody readily available for production in habeas proceedings. The Court will continue to consider requests for extensions on a case-by-case basis consistent with 28 U.S.C. § 2243. Federal Defendants-Respondents advise the Court that they have requested the Clerk of Court to add ICE as an interested party to be noticed in all newly filed immigration habeas matters to avoid future clerical errors and delays. Counsel for Plaintiffs-Petitioners is instructed to provide a list to Federal Respondents of all pre-existing habeas immigration cases with pending petitions or outstanding relief. Federal Defendants-Respondents are to ensure ICE is added to and noticed in those matters. Finally, the Court addresses Defendant-Respondent Darin Balaam's (ECF No. 140 ) Response to the 106 Amended Petition/Class Action Complaint, which requests that Balaam be named solely as an interested party. For the reasons set forth on the record, the Court finds Darin Balaam is the proper Defendant-Respondent for Class Members detained at Washoe County Detention Center. See Doe v. Garland, 109 F.4th 1188, 1197 (9th Cir. 2024). The Clerk of Court is kindly instructed to ADD United States Immigration Customs Enforcement as an interested party in this case and SEND through CM/ECF a copy of this Order to LVG.dutyattorney@ice.dhs.gov.
