ORDER DENYING 3 Motion for Temporary Restraining Order. In the 3 Motion, Petitioner seeks, inter alia, a bond hearing before an immigration judge. Given that Petitioner is requesting affirmative relief rather than maintenance of the status quo, Petitioner's request goes beyond the limited, temporary nature of a TRO and requires giving Respondents notice and an opportunity to be heard. ORDER GRANTING IN PART and DENYING IN PART 1 Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241. Petitioner, a noncitizen detained by Respondents at Moshannon Valley Processing Center, seeks, inter alia, immediate release from custody or, in the alternative, an individualized bond hearing before an immigration judge. Petitioner entered the United States without inspection on or about March 10, 2023. ECF No. 1 at 1; ECF No. 12 at 1. He was placed into expedited removal proceedings. ECF No. 12 at 1. Following an Asylum Officers determination that Petitioner established a credible fear of persecution on April 3, 2023, Petitioner was paroled into the country and transferred to full removal proceedings. ECF No. 1 at 1. Around April 2026, Petitioner was arrested and detained by Immigration and Customs Enforcement ("ICE"). Id.; ECF No. 12-3. Petitioners immigration proceedings are ongoing. The parties agree that the issue before the Court is whether Petitioner is subject to discretionary detention pursuant to 8 U.S.C. §1226(a) and therefore entitled to a bond hearing or mandatory detention under 8 U.S.C. § 1225(b) and therefore not entitled to a bond hearing. Respondents rely on the BIA's decision in Matter of M-S-, 27 I. & N. Dec. 509, 515-17 (A.G. 2019), which states that aliens "originally placed in expedited proceedings and then transferred to full proceedings after establishing a credible fear... remain ineligible for bond, whether they are arriving at the border or are apprehended in the United States." ECF No. 12 at 2. The Court is not persuaded by Respondents' reliance on Matter of M-S-, 27 I. & N. Dec. 509 (A.G. 2019) to attempt to distinguish this Petition from others granted by this Court. Unlike the noncitizen detainee in Matter of M-S-, who was in continuous custody, Petitioner was paroled into the country. Petitioner's detention is governed by § 1226(a) and he therefore has a statutory right to a bond hearing. See Bohorquez-Hernandez v. Noem, et al., No. 3:26-CV-231-CCW, ECF No. 10 (W.D. Pa. Mar. 13, 2026) (Wiegand, J.). Accordingly, IT IS HEREBY ORDERED that the 1 Petition for Writ of Habeas Corpus is GRANTED IN PART, as follows: within seven days of this Order, Petitioner must receive an individualized bond hearing conducted by an immigration judge pursuant to 8 U.S.C. § 1226. If Petitioner does not receive a bond hearing by that date, or if the immigration judge declines to conduct a bond hearing based on Matter of Yajure Hurtado and/or Matter of M-S-, Respondents shall immediately release Petitioner from custody. Within seven days of the immigration judge's decision, the parties must file a joint notice on the docket advising the Court of the outcome of the bond hearing. IT IS FURTHER ORDERED that the Petition is DENIED in all other respects. In particular, for the reasons set forth in this Court's prior decisions, the Court DENIES Petitioner's request for costs and attorney's fees pursuant to the Equal Access to Justice Act, 28 U.S.C. § 2412(d) because Respondents' position, while incorrect, was substantially justified.
