TEXT ORDER. The Government has conceded that Petitioner is entitled to a bond hearing under Da Cunha v. Freden, 175 F.4th 61 (2d Cir. 2026). Dkt. 11. Accordingly, Respondents' motion to dismiss (Dkt. 9) is denied, and the parties shall submit briefing addressing whether Petitioner's detention has now become "prolonged" under Velasco Lopez v. TEXT ORDER. The Court already concluded, based on Respondents' concession, that Petitioner is detained pursuant to 8 U.S.C. § 1226(a) under Second Circuit caselaw. Dkt. 12; see Da Cunha v. Freden, 175 F.4th 61 (2d Cir. 2026). In addition, based on the particular facts and circumstances at issue here, Petitioner is entitled to a bond hearing at which Respondents bear the burden to justify continued detention by clear and convincing evidence under Velasco Lopez v. Decker, 978 F.3d 842 (2d Cir. 2020). Respondents are to provide Petitioner with a bond hearing by July 9, 2026. The Clerk of Court shall enter judgment in accordance with this text order. SO ORDERED.
