TEXT ORDER denying 11 Motion for Expedited Consideration and Decision on Present Record. Upon the Courts review of the returns of service filed by the petitioner, the federal respondents have not been properly served. To serve a United States officer in their official capacity, Fed. R. Civ. P. 4(i)(2) requires a party to both serve the United States and also send a copy of the summons and of the complaint by registered or certified mail to the agency, corporation, officer, or employee. Based on the record before the Court, the petitioner has not served the United States as provided for in Rule 4(i)(1). Accordingly, the petitioners motion will be denied.
