Nunley on April 13, 2026: This matter is before the Court on Petitioner's Petition for Writ of Habeas Corpus (ECF No. 1 ) and Motion for Temporary Restraining Order (ECF No. 8 ) and Respondents' Motion to Dismiss (ECF No. 7 ). As set forth in the Court's upcoming Order, the Petition is GRANTED (ECF No. 1 ). Petitioner's Motion for TRO is DENIED as moot (ECF No. 8 ). Respondents' Motion to Dismiss is DENIED (ECF No. 7 ). Respondents are ORDERED to IMMEDIATELY RELEASE Petitioner (A # 226-113-581) from custody under the same conditions he was released prior to his current detention. At the time of release, Respondents must return all of Petitioner's documents and possessions. Respondents are ENJOINED and RESTRAINED from re-arresting or re-detaining Petitioner absent compliance with constitutional protections, including seven-days' notice and a pre-deprivation hearing. The Clerk of Court is directed to serve California City Detention Facility with a copy of this Order. A written order will follow.
