MINUTE ORDER IN CHAMBERS of the Honorable Richard F. Boulware, II on 10/30/2025.Before the Court is counseled Petitioner Fredy Perdomo-Gonzalez's 1 Petition for Writ of Habeas Corpus under 28 U.S.C. § 2241, 2 Motion for Preliminary Injunction, and 3 Motion to Consolidate Cases, challenging his continued detention at Nevada Southern Detention Center. The Court has reviewed the filings and finds that there are numerous errors, inconsistencies, and insufficient facts in the Petition and Motion for the Court to determine whether Petitioner can establish his entitlement to relief. Therefore, IT IS HEREBY ORDERED that Petitioner's counsel amend 1 Petition for Writ of Habeas Corpus and 2 Motion for Preliminary Injunction to include the following information no later than 5:00 p.m. on November 3, 2025: (1) The specific INDIVIDUAL relief requested on behalf of Petitioner Perdomo-Gonzalez; (2) Clarification as to any relief requested on behalf of a "Mr. Martinez" as referenced on page 6 of the 1 Petition; (3) Clarification as to any relief requested on behalf of any other individuals beyond named Petitioner Perdomo-Gonzalez; (4) The date, location, and circumstances of Petitioner Perdomo-Gonzalez initial arrest and detention; (5) The charges by ICE/DHS upon which removal proceedings are based; (6) The approximate date that Petitioner entered the United States; (7) The period that Petitioner has resided within the United States; (8) The arguments made by the parties at the bond hearing on September 17, 2025; (9) The written record of the IJ's decision denying bond; (10) Whether Petitioner or DHS appealed the IJ's decision denying bond; (11) The reason Petitioner seeks an injunction against Respondents staying his bond under 8 C.F.R 1003.19 where it does not appear the automatic stay has been invoked by ICE/DHS in this case; (12) The legal and factual basis for Petitioner's request for an injunction "barring the BIA from taking more than 30 days to adjudicate a bond appeal." IT IS FURTHER ORDERED that Petitioner's counsel comply with the requirements of this Courts local rules, including, but not limited to, LR IA 10-1 (Form of Papers Generally), and specifically LR IA 10-1(b), which requires electronically filed documents to be filed in a searchable Portable Document Format (PDF), and LR 7-4 (Emergency Motions), which sets forth the requirements for filing emergency motions. ORDER Granting 2 Petitioner's Motion for Preliminary Injunction.IT IS FURTHER ORDERED that Respondents must provide Petitioner with a bond hearing pursuant to 8 U.S.C.§ 1226(a) no later than December 12, 2025. IT IS FURTHER O RDERED that Respondents are enjoined from denying Petitioner release on bond on the basis that he is subject to mandatory detention pursuant to 8 U.S.C. § 1225(b)(2).In the event that bond is granted, Respondents are ORDERED to imme diately release Petitioner. The Court has received notice of the hardship other petitioners have incurred in their efforts to satisfy bond, and therefore, the Court FURTHER ORDERS that Petitioner be afforded 45 days from the date of releas e to satisfy any monetary bond conditions.IT IS FURTHER ORDERED that if the individualized bond hearing is not conducted by December 12, 2025, Petitioner shall be immediately released until it is determined that his detention is warranted u nder 8 U.S.C. § 1226(a).
