TEXT ORDER - The Court has reviewed the Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 (ECF No. 1) and the Motion for an Order to Show Cause (ECF No. 2) filed by Petitioner, Hector Rene Hernandez Aguilar, who is presently detained at Delaney Hall Detention Facility in Newark, New Jersey. Petitioner alleges that he is a citizen of Honduras who initially entered the United States on August 13, 2016, and thereafter filed an application for asylum, withholding of removal, and protection under the Convention Against Torture, which was denied. Petitioner was ordered removed on January 7, 2020, and his appeal was denied on November 12, 2021. Petitioner further alleges that he reentered the United States in 2023 and has resided here since that time. He represents that he has a pending I-130 Petition for Alien Relative and no criminal record. Petitioner contends that he was detained on February 7, 2026, pursuant to 8 U.S.C. § 1225(b), and that his continued detention violates the Due Process Clause of the Fifth Amendment. (Id.) Accordingly, Petitioner's Motion for an Order to Show Cause is GRANTED. (ECF No. 2.) It is ORDERED that Respondents shall SHOW CAUSE, on or before April 14, 2026, why the Petition should not be granted. Petitioner may file a reply within three (3) business days after Respondents file their response. Petitioner shall serve a copy of this Order and the Petition upon Respondents within two (2) business days of the entry of this Order and shall promptly file proof of service on the docket.
