ORDER DENYING 1 Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241. Petitioner, a noncitizen detained by Respondents at Moshannon Valley Processing Center, seeks, inter alia, immediate release from custody or, in the alternative, an individualized bond hearing before an immigration judge (IJ). Petitioner argues that he is subject to discretionary detention pursuant to 8 U.S.C. §1226(a), as opposed to mandatory detention under 8 U.S.C. § 1225(b), and is therefore entitled to a bond hearing. ECF No. 1. Respondents contend that the 1 Petition is moot because Petitioner has already received two bond hearings. ECF No. 8 at 1-2. At Petitioners first hearing on 12/3/2025, an immigration judge denied Petitioner bond on jurisdictional grounds. See ECF No. 8-1 at 3-4. At a second bond hearing on 3/2/2026, after finding that Petitioner was a flight risk, an IJ denied Petitioner bond. Id. at 1-2. In his Reply, Petitioner acknowledges that he received a bond hearing before an IJ on 3/2/2026, but argues that it was conducted under the wrong statute, and is therefore inadequate. ECF No. 12 at 1-2. However, Petitioner offers no legal or factual support for this argument. The order reflects the IJs finding that Petitioner is a flight risk and subsequent denial of bond, pursuant to 8 U.S.C. § 1226(a). See ECF No. 8-1 at 1-2. Because the 1 Petition seeks a bond hearing under 8 U.S.C. § 1226(a) and Petitioners 3/2/2026 hearing constitutes a bond hearing under that provision, the 1 Petition is therefore moot. See Khoshimov v. Oddo, 3:26-CV-00381-CCW (W.D. Pa. Mar. 24, 2026) (Wiegand, J.) (citing Kingsly v. Doll, No. 1:17-CV-02059, 2019 WL 3069689, at *3 (M.D. Pa. May 6, 2019), report and recommendation adopted at 2019 WL 3067253 (M.D. Pa. July 12, 2019) ([S]ince [Petitioner] has been given the relief he requesteda bond hearinghis petition is now moot.)).
