TEXT ORDER: The Court has reviewed the Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 (ECF No. 1 ) filed by Petitioner, Rodriga Alvarez Hernandez, who is presently detained at Delaney Hall Detention Facility in Newark, New Jersey. Petitioner, a citizen of Mexico, alleges that she entered the United States in 1994 and has resided here continuously since that time. She further represents that she has a pending Form I-918 Petition for U Nonimmigrant Status as a derivative beneficiary of her United States citizen husband. Petitioner alleges that she was detained by Immigration and Customs Enforcement while attending a biometrics appointment on April 6, 2026, and contends that her detention pursuant to 8 U.S.C. § 1225(b) is unlawful and that her continued detention violates the Due Process Clause of the Fifth Amendment. Accordingly, it is ORDERED that Respondents shall SHOW CAUSE, on or before April 14, 2026, why the Petition should not be granted. Petitioner may file a reply within three (3) business days after Respondents file their response. Petitioner shall serve a copy of this Order and the Petition upon Respondents within two (2) business days of the entry of this Order and shall promptly file proof of service on the docket.
